Amendment #25 to H4912

Municipal Opt-In Clean Heating Code

Representatives Vitolo of Brookline and Khan of Newton move to amend the bill, as amended, by inserting the following new section:

Section XX: Section 94 of chapter 143 of the General Laws, as so appearing, is hereby amended by adding after clause (o) the following clause:-

 

“(o 1/2) In consultation with the department of energy resources, to develop regulations as part of the state building code to ensure that all new construction and major renovations utilize electricity or fossil fuel free technology to provide space heating and cooling and water heating, except in circumstances where such requirements are deemed technically or economically infeasible or inappropriate pursuant to regulation. The provisions referenced in this subsection shall be known as the “Clean Heating Code,” and shall be an optional code separate from the energy efficiency provisions commonly known as the “Stretch Energy Code” referenced in subsection (o). Notwithstanding any provision of State law to the contrary, no city or town shall be prohibited from enacting the Clean Heating Code.”.
