Amendment #136 to H5150

Prohibiting Child Labor Use in the Acquisition of Mica

Mr. Dooley of Norfolk moves to amend the bill by adding the following section:

 

SECTION XXXX:  Notwithstanding the provision of any General or Special law to the contrary, no transportation authority or agency of the Commonwealth shall procure material, stock, services  or otherwise contract with any entity utilizing raw materials including but not limited to mica mined through unfair child labor or other exploitative child labor practices inconsistent with the  United States Fair Labor Standards Act of 1938 as amended, 29 United States Code ss 201 et seq.  The Secretary of the Executive Office of Transportation and Construction or the General Manager or Chief Procurement Officer of such transportation authority or agency shall certify to the Auditor of the Commonwealth that any procurement or contract made by such authority or agency satisfies the requirements of this section.
