Amendment #47 to H5150
police officer death by COVID-19
Mr. LeBoeuf of Worcester moves to amend the bill by adding the following section:
“SECTION XX. Subsection (c) of section 100A of chapter 32 of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by adding the following paragraph:
For the purposes of this section, the term “killed in the line of duty” shall include the death of a police officer from COVID-19, unless competent medical evidence establishes that the death was directly and proximately caused by something other than COVID–19, if: (i) the police officer was diagnosed with COVID–19, or evidence indicates that the police officer had COVID–19, during the 45-day period beginning on the last day of duty of the officer; and (ii) evidence indicates that the police officer had COVID–19, or complications therefrom, at the time of the police officer’s death.”
