Ensuring compliance

Ms. Rausch and Mr. Pacheco move that the proposed new draft be amended in Section 31, by inserting after paragraph (c)(1) the following paragraph:-

“Failure of an owner of a building to comply with the requirements of this subsection shall make the owner liable for a civil administrative penalty not to exceed $500 for each day of the violation, starting after the expiration of the applicable deadline or any extension granted to the building owner. A residential tenant shall not be held responsible for paying a penalty, or any portion thereof, for the failure of the building owner to report energy use information in a timely fashion.”
