Automated license plate readers
Ms. Creem, Mr. Boncore, Ms. Comerford, Ms. Rausch, Messrs. Eldridge, Hinds and Montigny, Ms. Chang-Diaz, Ms. Jehlen, Mr. Brady and Ms. Lovely move that the proposed new draft be amended by inserting in line 13, after the words “is installed.” the following new definition:-
“Automated license plate reader system”, an automated system of one or more mobile or fixed high speed cameras used in combination with computer algorithms to convert images of license plates into computer-readable license plate identifying data.
And, by inserting in line 246, after the words “this chapter.”, the following new words:
(f) Persons acting under color of state law shall not disclose, sell or permit access to data collected by an automated license plate reader system except as required in a judicial proceeding, or access automated license plate reader system data from other governmental or non-governmental entities except pursuant to a valid warrant; provided, however, that a law enforcement agency may disclose or access automated license plate reader system data if the agency reasonably believes that an emergency involving imminent danger of death or serious physical injury requires such disclosure or access.
