Ensuring the Proper Use and Application of Telehealth Services

Ms. Lovely moves that the proposed new draft be amended in SECTIONS 3, 49, 52, 53, 53, 55, and 56 by striking out the wording “as if the service was delivered in person” and inserting in place thereof the following:-

“pursuant to chapter 176O”.

and further moves, in SECTIONS 3, 49, 52, 53, 53, 55, and 56, by striking out the wording “Health care services delivered via telehealth shall be covered to the same extent as if they were provided via in-person consultation or delivery” and inserting in place thereof the following:-

“Coverage shall be made available for all covered services that are clinically appropriate to be provided through telehealth and that do not require in-person treatment of a patient”

and further moves, in SECTIONS 3, 49, 52, 53, 53, 55, and 56, by inserting after the word “profession“ the following:-

“and in compliance with licensure regulations and requirements, programmatic regulations, and performance specifications related to the service using telehealth as is applicable to the delivery of the services in person. If the provider cannot meet this standard of care or other requirements, the provider must direct the patient to seek in-person care. The provider must make this determination prior to the delivery of each service.”
