Notwithstanding any general or special law or rule or regulation to the contrary, the Massachusetts Bay Transit Authority (MBTA), when setting daily parking rates at any bus, ferry, commuter rail, or subway station shall charge one rate for one calendar day of parking.  A calendar day shall be defined as 12:00 a.m. to 11:59 p.m. of the same calendar day.  The MBTA shall not charge a separate higher rate for parking based on the amount of time a rider has parked if the entrance and exit to the parking facility occur on the same calendar day. The MBTA may charge lower rates based on the day of the week."

"SECTION XX. Notwithstanding any general or special law to the contrary, the Massachusetts Department of Transportation shall conduct a feasibility study relative to extending rapid transit service from the current terminus of the Massachusetts Bay Transit Authority’s Blue Line at Wonderland Station in the City of Revere to the Massachusetts Bay Transit Authority Commuter Rail station in the City of Lynn.

SECTION XX. The study shall examine and evaluate the costs and economic opportunities related to extending Blue Line service or otherwise expanding rapid transit service from the City of Revere to the City of Lynn, including but not limited to: (i) the projected capital costs; (ii) the projected operating costs and revenue estimates; (iii) the projected ridership levels; (iv) the prospect of operating on existing rights of way and other operational issues; (v) the environmental and community impact estimates; (vi) the availability of federal, state, local and private sector funding sources; (vii) the environmental and social justice benefits and burdens specific to the demographics of the region; (viii) regional equity in rapid transit investments in the commonwealth, and (viii) the potential economic, social and cultural benefits to the greater north shore region and the commonwealth  as a whole.

SECTION XX. The department shall file the report with the clerks of the house and senate, the chairs of the house and senate committee on ways and means and the senate and house chairs of the joint committee on transportation not later than March 31, 2020."

SECTION_. Section 3 of chapter 90C of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by striking out the first paragraph of clause (A)(4) and inserting in place thereof the following paragraph:-

A violator may contest responsibility for the infraction by making a signed request for a noncriminal

hearing on the citation and mailing such citation, together with a $25 court filing fee, to the registrar at

the address indicated on the citation within 20 days of the citation. Notwithstanding any general or

special law to the contrary, the registrar, in cooperation with the state comptroller, upon receipt of the

$25 court filing fee, shall cause the court filing fee to be transferred to the trial court department;

provided, however, that the registrar may periodically retain an amount necessary to pay refunds of

said fees for dispositions that result in findings of not responsible; and provided further that the registrar

may retain an amount not greater than $200,000 annually for personnel costs associated with the

processing of those filing fees.

"SECTION XX. Notwithstanding any general or special law to the contrary, the highway division of the Massachusetts Department of Transportation shall immediately take by eminent domain pursuant to chapter 79 of the General Laws a fee interest in the portion of Briarwood road in the town of Bourne which traverses the Commonwealth’s Rail & Transit Division Right of Way, including the bridge at mile post 2-36 and attendant structures, and a permanent easement interest in and to the abutments to the extent necessary to properly complete construction, for all purposes consistent with the emergency rehabilitation and repair of the same for the safety of the public.

SECTION XX. The highway division shall undertake and fund all necessary and immediate repairs required to rehabilitate the portion of Briarwood road taken pursuant to SECTION XX and the bridge at mile post 2-36.

SECTION XX. Notwithstanding any general or special law to the contrary, no permit shall be required from any state or local agency or body for the necessary and immediate repairs contemplated by this act.

SECTION XX. Notwithstanding said chapter 79, no appraisal of damages shall be required before any taking by eminent domain for the purposes of this act. Any appraisals required for the purposes of this act shall be undertaken and funded by the highway division."

Mr. Hinds moved that the proposed new text be amended in section 2E, in item 1595-6368, by adding the following words:- "; provided, that not less than $270,000 shall be expended for the pilot season of the Berkshire Flyer, a weekend passenger rail service connecting New York city and the Berkshires between Memorial Day and Columbus Day in calendar year 2020, deemed economically viable and beneficial by the study conducted pursuant to section 137 of chapter 47 of the acts of 2017; provided further, that not more than $30,000 of this appropriation shall be made available to the Berkshire regional transit authority to hire a project manager during the pilot season; provided further, that not later than December 31, 2019, the Massachusetts Department of Transportation shall develop and execute a memorandum of understanding with the Berkshire regional transit authority, which shall serve as the local sponsor of the Berkshire Flyer, as defined in the report filed  section 101 of chapter 154 of the acts of 2018; provided further, that the memorandum of understanding shall define: (i) the responsibilities of the local sponsor and the Massachusetts Department of Transportation during the pilot season; (ii) how funding will be distributed to and from the Massachusetts Department of Transportation, Amtrak and the Berkshire regional transit authority; and (iii) all fiscal liabilities assumed during the pilot season including, but not limited to, responsibilities and fiscal requirements prescribed by section 209 of the federal Passenger Rail Investment and Improvement Act of 2008; provided further, that the memorandum of understanding shall clearly delineate the functions of and funding for the pilot for all parties and the conditions under which service decisions shall be made "; and

in said section 2E, in said item 1595-6368, by striking out the figure "$343,879,616" and inserting in place thereof the following figure:- "$344,149,616".

Said review shall be commence no later than 45 days after the passage of this act

Said review and any recommendations shall be submitted to the massachusetts bay transportation authority fiscal control board, the joint committee on transportation, the house and senate committee on ways and means and the clerks of the house and senate."

Selective Service

Messrs. O'Connor, Tarr and Fattman moved that the proposed new text be amended by inserting after section XX the following sections:-

“SECTION XX. Chapter 90 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after section 8M the following section:-

Section 8N. (a) A male applicant who applies for an operator’s license, learner’s permit, identification card or a renewal of any such permit or license and who is at least 18 years of age but less than 26 years of age authorizes the registrar to register the applicant with the Selective Service System in compliance with section 3 of the Military Selective Service Act through the applicant’s signature on the application unless the applicant indicates otherwise as described in subsection (b).

(b) The registrar shall give notice to any male applicant who is at least 16 years of age but less than 26 years of age that the applicant has a duty under federal law to register with the Selective Service System at age 18. If the applicant has not registered within 30 days after reaching 18 years of age, he shall be informed that he still has an affirmative obligation under federal law to register with the Selective Service System before reaching 26 years of age. The registrar shall also notify the applicant that his signature on an application for any such license, permit, identification card or renewal shall constitute consent to authorize the registrar to forward the applicant’s information to the Selective Service System, registering the applicant with the Selective Service System unless the applicant declines to give such consent by signing a statement so stating on the application.

(c) If the applicant is at least 16 years of age but less than 18 years of age the registrar shall notify the applicant that his signature on an application for any such license, permit, identification card or renewal shall constitute consent authorizing the applicant to be registered upon attaining 18 years of age as required by federal law.

(d) The registrar shall notify the applicant that a refusal to grant such consent shall not be grounds for denial of driving privileges nor shall it be a basis for the registrar to discriminate against the applicant, and that the opportunity to give such consent to the registrar is provided only for the convenience of the applicant. This notice shall be made both verbally and through a written document available in English, Spanish and such other languages as the registrar determines. If the applicant grants that authority, the registrar shall forward to the Selective Service System, in an electronic format, no sooner than the applicant’s eighteenth birthday, only the information necessary for registration of the applicant.

(e) Failure to grant such authority as provided in this section shall not be a basis for the registrar or any other related government agency to discriminate against the applicant, including but not limited to the denial of driving privileges.

(f) The registrar shall not distribute or make available to any person or governmental agency in any way any list of those applicants who declined to grant the registrar authority to forward their information to the Selective Service System. The registrar shall not compile, develop or maintain any such list unless it is necessary for the administration and operation of the registry, and such list shall not be given to any other governmental or non-governmental agency. The registrar shall not distribute or make available to any person or governmental agency any list of those applicants who did grant the registrar authority to forward their information to the Selective Service System except as otherwise authorized by this section.

SECTION XX. Implementation of this act shall be contingent on the receipt by the registrar of motor vehicles of sufficient federal funds to pay a reasonable portion of the initial start-up costs for computer programming changes necessary to implement the requirements of this section related to the reporting of information to the Selective Service Administration. The registrar shall initiate and monitor efforts to obtain federal funds for the purposes stated in this act and shall report promptly to the joint committee on public safety and the house and senate committees on ways and means when federal funds have been received by the department.”

“SECTION XX.  Notwithstanding any general or special law to the contrary, the Massachusetts Bay Transportation Authority shall conduct a feasibility study to extend orange line services to Roslindale Square in the Roslindale section of the City of Boston.  Said study shall be filed with the Joint Committee on Transportation and House and Senate Committees on Ways and Means by no later than December 31, 2019."
