Mandatory Subject of Bargaining With Employee Organizations

Messrs. Feeney, Eldridge and Crighton moved that the proposed new text be amended by inserting after Section __, the following section:-

Section XX. Notwithstanding any general or special law to the contrary, the Commonwealth in its capacity as an employer under Chapter 150E of the General Laws  and its political subdivisions are hereby prohibited from the collection of any contribution or fee under Chapter 175M which was established under Section 29 Chapter 121 of the Acts of 2018 from a public employee represented by an employee organization pursuant to Chapter 150E, until the Commonwealth and its political subdivisions, respectively, have bargained with the respective employee organizations representing said employees over the implementation of Section 6  of Chapter 175M and the parties have entered into a memorandum of agreement for the implementation of Section 6 of Chapter 175M.

Notwithstanding any general or special law to the contrary, the Commonwealth and its political subdivisions employing persons represented by an employee organization pursuant to Chapter 150E shall bargain upon request over the decision and impact of the question of whether to adopt a private plan pursuant to section 11(a)(1) of said chapter 175M to provide family and medical leave.
