Statewide Election Cybersecurity

Section _. Notwithstanding any special or general law to the contrary, the secretary of state, in consultation with the United States election assistance commission, shall develop and promulgate new rules and standards to ensure the cyber-security and general security of elections in the Commonwealth to combat election fraud and other election security threats.

Such rules as promulgated by the secretary shall be in compliance set forth by the United States department of homeland security as to the requirements of election security.

Early Voting

Messrs. Tarr, deMacedo, Humason, Fattman and O'Connor moved that the proposed new text be amended by inserting after section __ the following:-

"SECTION _. Section 25B of Chapter 54 of the General Laws is hereby amended by inserting at the end thereof the following new subsection:-

“(r) The commonwealth shall reimburse each city and town to the full extent of the amounts expended for mandated early voting procedures and operations. The state treasurer shall annually, on or before July 1st of the year following the election for which reimbursement is being sought, pay to cities and towns, the sums required for such reimbursement and approved by the secretary of state pursuant to section 2 herein. Each city and town may establish an Early Voting Reimbursement Fund. Reimbursements made by the commonwealth pursuant to this section may be deposited into the fund and may carry forward for 1 fiscal year.”

SECTION _. Section 25B of Chapter 54 of the General Laws is hereby amended by inserting in subsection (o) the following at the end thereof:-

“including the means to seek, process and approve reimbursement subject to subsection (r)”

Early Voting

"SECTION 15A. Section 25B of chapter 54 of the General Laws, as so appearing, is hereby amended by adding the following subsection:-

(r) The commonwealth shall reimburse each city and town an amount sufficient to defray the mandated costs imposed on the city or town under this section; provided, however, that annually not later than September 15, the state auditor shall determine and deliver to the state secretary a statement of the incremental costs attributed to this section and costs incurred by each city and town in the previous fiscal year; and provided further, that this amount shall be limited to statutorily obligated expenses and shall not include incidental and subordinate local administration expenses as determined by the state auditor.”.

Employee Vacation and Earned Sick Leave Credit Task Force

Messrs. Tarr, deMacedo, Humason and Fattman moved that the proposed new text be amended by inserting after section__, the section:-

"SECTION __. Notwithstanding any general or special law to the contrary there shall be established an employee vacation and earned sick leave credit task force to study and make recommendations on establishing a uniform state policy regarding the cash out of vacation and sick leave credits applicable to employees of the commonwealth who are in positions that are not subject to collective bargaining agreements. The task force shall be comprised of the following 11 members or their designees: the secretary of administration and finance who shall serve as chair; the administrator of the trial court; the colonel of state police; the chair of the board of higher education; 1 person to be appointed by the speaker of the house of representatives; 1 person to be appointed by the senate president; 1 person to be appointed by the minority leader of the house of representatives; 1 person to be appointed by the minority leader of the senate; and 3 persons to be appointed by the governor, 1 of whom shall have experience in labor law.

The task force shall study and make recommendations on establishing the following uniform policies and shall examine the practices of neighboring states: (i) rate of accrued sick leave; (ii) cash out of sick leave credit upon retirement; (iii) payment of sick leave credits upon the death of an employee; and (iv) transfer of sick leave credits from other political subdivisions of the commonwealth. In addition, the task force shall study the feasibility of establishing an extended illness leave bank for all employees of the commonwealth.

The task force shall convene not later than 30 days after the effective date of this act and shall file its recommendations with the clerks of the house of representatives and senate not later than December 31, 2019."

Green LED Light Study

Notwithstanding any special or general law to the contrary, the operational services division in consultation with the division of capital asset management shall conduct a study and develop a plan to implement the use of light-emitting diode, or LED, lights in all buildings owned or leased by commonwealth.

Said study and plan along with any recommendations shall be completed and submitted to the clerks to the house and senate to ensure that the transition to the use of light-emitting diode, or LED lights is completed within 18 months from the enactment of this act.

Municipal Impact Statement

Messrs. Tarr, deMacedo, Humason, Fattman and O'Connor moved that the proposed new text be amended by inserting after section _the following sections:-

SECTION _. Section 6B of chapter 11 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting in line 12 after the word “C” the following words:- "and the significant financial impacts under this section".

SECTION _. Section 6B of said chapter, as so appearing, is hereby amended by deleting, in line 19, the words “every five years”.

SECTION _: Section 6B of said chapter, as so appearing, is hereby amended by inserting, in line 21, after the word “towns.” the following words:- "The division shall also review every five years newly enacted laws and administrative regulations which have a significant financial impact upon cities and towns.".

SECTION _. Section 6B of said chapter, as so appearing, is hereby amended by deleting, in line 23, the word “or” and inserting, in line 24, after the word “expenditures” the following words:- ", or grant or increase exemptions from local taxation".

Sheriff Forfeiture Trust Funds

Messrs. deMacedo and O'Connor moved that the proposed new text be amended by inserting after Section 72 the following new section:-

"SECTION XX. Subsection (d) of section 47 of chapter 94C of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by striking out the third paragraph and inserting in place thereof the following paragraph:-

There shall be established within the office of the state treasurer separate special law enforcement trust funds for each sheriff, district attorney and for the attorney general. All such monies and proceeds received by any sheriff, prosecuting district attorney or attorney general shall be deposited in such a trust fund and shall then be expended without further appropriation to defray the costs of protracted investigations, to provide additional technical equipment or expertise, to provide matching funds to obtain federal grants, or such other law enforcement purposes as the sheriff, district attorney or attorney general deems appropriate. The sheriff, district attorney or attorney general may expend up to 10 per cent of the monies and proceeds for drug rehabilitation, drug education and other anti-drug or neighborhood crime watch programs which further law enforcement purposes. Any program seeking to be an eligible recipient of said funds shall file an annual audit report with the local sheriff, district attorney and attorney general. Such report shall include, but not be limited to, a listing of the assets, liabilities, itemized expenditures, and board of directors of such program. Within 90 days of the close of the fiscal year, each sheriff, district attorney and the attorney general shall file an annual report with the house and senate committees on ways and means on the use of the monies in the trust fund for the purposes of drug rehabilitation, drug education, and other anti-drug or neighborhood crime watch programs."

Authorization to Insure Commonwealth Property

"SECTION __. Section 30 of chapter 29 of the General Laws, as so appearing, is hereby amended by adding the following sentence:-

'Notwithstanding the foregoing sentence, the executive office for administration and finance may, in consultation with the Massachusetts emergency management agency, approve a state agency request for permission to insure a property of the commonwealth that has been damaged if the costs of repair for the property are eligible under a presidentially declared disaster and the state agency would otherwise be ineligible for federal reimbursement unless insurance is obtained and maintained.'"

Mandatory Subject of Bargaining With Employee Organizations

Mr. Feeney moved that the proposed new text be amended by inserting after section _ the following sections:- "SECTION XX. Notwithstanding any general or special law to the contrary, the Commonwealth is hereby prohibited from the collection of any tax or fee as required under chapter 121 of the Acts of 2018 from a state employee represented by an employee organization pursuant to c. 150E, until the Commonwealth has bargained with the employee organizations representing said employees over the implementation of said chapter 121, and the parties have entered into a memorandum of agreement for the implementation of chapter 121."

Mandatory Subject of Bargaining With Employee Organizations

Messrs. Feeney, Eldridge, Crighton, Timilty and O'Connor moved that the proposed new text be amended by inserting after Section _ the following section:-

"Section XX. Notwithstanding any general or special law to the contrary, the Commonwealth in its capacity as an employer under Chapter 150E of the General Laws and its political subdivisions are hereby prohibited from the collection of any contribution or fee as required under Section 6 of Chapter 121 of the Acts of 2018 from a public employee represented by an employee organization pursuant to Chapter 150E, until the Commonwealth and its political subdivisions, respectively, have bargained with the respective employee organizations representing said employees over the implementation of Section 6 of Chapter 121, and the parties have entered into a memorandum of agreement for the implementation of Section 6 of Chapter 121.

Notwithstanding any general or special law to the contrary, the Commonwealth and its political subdivisions employing persons represented by an employee organization pursuant to Chapter 150E shall bargain upon request over the decision and impact of the question of whether to adopt a private plan pursuant to section 11(a)(1) of said chapter 121 to provide family and medical leave."

Chapter 54, Section 24 of the General Laws is hereby amended by deleting the following language "…Alcoholic beverages shall not be sold in any portion of a building which is designated as a polling place, during voting hours or while ballots are being counted…”, and replacing it with the following language. “…Alcoholic beverages shall not be served or consumed in that portion of a building used as a polling place, during voting hours or while ballots are being counted therein…".

GIC Dental and Vision Benefits for Municipal Employees

Mr. Keenan moved that the proposed new text be amended by inserting at the end thereof the following new sections:-

SECTION XX. Section 19 of chapter 32B of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting after subsection (j), the following subsection:-

(k) Notwithstanding any other general or special law to the contrary, agreements reached by an appropriate public authority and the public employee committee under subsection (a) to transfer all subscribers to the commission under subsections (e) and (f), may be modified by further agreement to allow active employees and their dependents to enroll in the dental and vision insurance plan provided by the commission to retirees, surviving spouses and their dependents under subsection (j),with premium contribution ratios and administrative fees for active employees and their dependents to be negotiated by said appropriate public authority and public employee committee. The commission shall provide dental insurance coverage, under its plan for retirees, surviving spouses and their dependents insured under Chapter 32A, to active employees and their dependents who elect the coverage under this subsection, as it so provides health insurance coverage under sections (e) and (f). The commission may charge an administrative fee, which shall not be more than 1 percent of the cost of total dental insurance premiums for the active employees and their dependents who enroll in the dental plan under this section, to be determined by the commission which shall be considered as part of the cost of coverage for purposes of determining the contributions of the political subdivision and its active employees and their dependents to the cost of insurance coverage by the commission.

SECTION XX. Section 23 of said chapter 32B, as so appearing, is hereby amended by inserting after subsection (i), the following subsection:-

(j) Notwithstanding any other general or special law to the contrary, agreements reached by an appropriate public authority and the public employee committee to transfer all subscribers, for whom the authority provides health insurance coverage, to the commission under this section, may be modified by further agreement to allow active employees and their dependents to enroll in the dental and vision insurance plan provided by the commission to retirees, surviving spouses and their dependents under subsection (i),with premium contribution ratios and administrative fees for active employees and their dependents to be negotiated by said appropriate public authority and public employee committee. The commission shall provide dental insurance coverage, under its plan for retirees, surviving spouses and their dependents insured under Chapter 32A, to active employees and their dependents who elect the coverage under this subsection, as it so provides health insurance coverage under this section. The commission may charge an administrative fee, which shall not be more than 1 percent of the cost of total dental insurance premiums for the active employees and their dependents who enroll in the dental plan under this section, to be determined by the commission which shall be considered as part of the cost of coverage for purposes of determining the contributions of the political subdivision and its active employees and their dependents to the cost of insurance coverage by the commission.

Amputee Injury Trust Fund

Messrs. Fattman, deMacedo and Tarr moved that the proposed new text be amended by inserting after section _ the following section:-

Section XX: (a) There is hereby established on the books of the commonwealth a separate trust fund known as the Amputee Injury Trust Fund. The trust fund shall consist of monies paid to the Commonwealth from a surcharge of an additional $20 assessed against any person who seeks reinstatement of their license to operate after being suspended as a result of receiving 3 speeding convictions under section 17 of chapter 90 within any 1-year period or as a result of receiving 5 or more moving violations or surchargeable offenses within any 3-year period. The first $10 of each surcharge shall be transferred by the registrar of motor vehicles to the state treasurer for deposit into the Amputee Injury Trust Fund. The remaining amount shall be transferred by the registrar to the state treasurer for deposit in the General Fund.

(b) The state treasurer shall be the custodian of the Amputee Injury Trust Fund and shall receive, deposit, and invest all monies transmitted to him under this section and shall credit interest and earnings on the trust fund to the trust fund. The monies shall be expended for the purpose of medical cure research services for spinal cord injured persons in such manner as the commissioner of public health may direct.

(c) The commissioner of public health shall appoint an advisory board, consisting of 2 physicians and 1 member of the amputee community for the purpose of reviewing proposals for funding research in amputee injuries and making any related recommendations.

Sick Leave Buybacks

Mr. Fattman moved that the proposed new text be amended by inserting after section _ the following sections:-

SECTION XX. Section 31A of said chapter 29, as appearing in the 2016 Official Edition, is hereby amended by adding the following 2 subsections:-

(e) No employee of the commonwealth shall accrue more than 1,000 hours of unused sick leave credits.

(f) No employee of a public institution of higher education listed in section 5 of chapter 15A shall accrue more than 1,000 hours of unused sick leave credits.

SECTION XX. Notwithstanding any general or special law to the contrary, section xx shall take effect for any employee of the commonwealth and any employee at public institutions of higher education listed in section 5 of chapter 15A of the General Laws who has accrued not more than 1,000 hours of unused sick leave credits, on the effective date of this act. Any such employee who has accrued more than 1,000 hours of unused sick leave credits as of the effective date of this act shall not accrue credits in excess of those credits, but may accrue credits to replenish any sick time that is used after the effective date of this act, up to the maximum of 1,000 hours set forth above.

SECTION XX. Notwithstanding any general or special law to the contrary, the personnel administrator shall promulgate revised rules under the second paragraph of section 28 of chapter 7 of the General Laws to incorporate the changes enacted in subsection (e) of section 31A of chapter 29 of the General Laws and section 65 of this act, which revisions shall take effect as soon as practicable after the effective date of this act.

SECTION XX. Notwithstanding any general or special law to the contrary, the department of higher education and the University of Massachusetts shall revise the necessary rules and policies in order to incorporate the changes enacted in subsection (f) of section 31A of chapter 29 of the General Laws and section 65 of this act, which revisions shall take effect as soon as practicable after the effective date of this act.

Single Sales Rate Factor Analysis

The department may, in conducting its analysis, seek input from interested stakeholders. The commission shall analyze reimbursement financing for payments in lieu of taxes including, but not limited to: (i) the correlation between changes in acreage of commonwealth-owned land and available funding for payments in lieu of taxes for commonwealth-owned land; (ii) the extent to which the formula reflects the needs of municipalities and the proportional distribution of payments in lieu of taxes for commonwealth-owned land; (iii) any disparities that exist among municipalities related to reimbursements for payments in lieu of taxes for commonwealth-owned land; (iv) the economic impact on local economies of reimbursements for payments in lieu of taxes for commonwealth-owned land; and (v) any alternative formulas, processes and methods that may create a more equitable distribution of reimbursements for payments in lieu of taxes for commonwealth-owned land.

The commission shall include, but not be limited to: the house and senate chairs of the joint committee on revenue or their designees, who shall serve as co-chairs; the governor or a designee, the secretary of administration and finance or a designee; the commissioner of revenue or a designee; the secretary of energy and environmental affairs or a designee; the commissioner of conservation and recreation or a designee; the speaker of the house of representatives or a designee; the president of the senate or a designee; the minority leader of the house of representatives or a designee; the minority leader of the senate or a designee; the chair of the house committee on ways and means or a designee; the chair of the senate committee on ways and means or a designee; and 1 person to be appointed by each of the following organizations: the Massachusetts Municipal Association; the Lincoln Institute of Land Policy; the rural policy advisory commission; and the Massachusetts Taxpayers Foundation, Inc.

The commission shall file a report of its findings and recommendations, including any new or revised payment in lieu of taxes reimbursement formulas, with the clerks of the senate and house of representatives and the house and senate committees on ways and means not later than March 2, 2020.”.

SECTION XX. Paragraph (a) of Part B of Section 3 of chapter 62 of the General Laws is hereby amended by inserting after subparagraph (19) the following new subparagraph:-

(20) (a) An amount equal to premiums paid or accrued for qualified mortgage insurance by the taxpayer during the taxable year in connection with acquisition indebtedness with respect to a primary residence.

(b) The amount under clause (a) shall be reduced (but not below zero) by 10 percent of such amount for each $1,000 that a persons adjusted gross income for the taxable year exceeds $100,000.

Section XX. Section 1 of chapter 62 of the General Laws, as so appearing, is hereby amended by inserting after paragraph (r) the following new paragraph:-

(s) “Qualified mortgage insurance,” shall mean private mortgage insurance, as defined within 12 U.S.C. 4901, or commonly referred to as insurance that reimburses a mortgage lender if the buyer defaults on the loan and the foreclosure sale price is less than the amount owed the lender.

Ms. Rausch moved that the proposed new text be amended in section 2, in item 1790-0100, by inserting after the words “chargeback system for its information technology services”, the following:- “; provided further, that each office, agency, or other unit utilizing said information technology services shall submit to the auditor, the house and senate committees on ways and means, and the joint committee on state administration and regulatory oversight quarterly reports detailing such usage, including but not limited to an accounting of any equipment or services underutilized during the reporting period”; and in said item by inserting after the words “obligate funds for the project or purchase”, the following:- “; provided further, that similar approval shall be obtained from the house and senate committees on ways and means prior to any obligation of funds for a project or purchase with a cost exceeding $200,000; provided further, that the secretary shall not expend for any project a total sum of $250,000 or more, regardless of source of funds or authorization for such expenditure, unless the secretary first submits to the auditor, the house and senate committees on ways and means, and the joint committee on state administration and regulatory oversight a complete accounting of and justification for said anticipated expenditure; provided further, that the secretary shall create and implement a comprehensive information governance plan for the executive office and all information technology services provided by the executive office, which information governance plan shall include but not be limited to defensible destruction, offboarding, privacy and security, and lifecycle management; provided further, that the secretary shall submit said information governance plan to the auditor, the house and senate committees on ways and means, and the joint committee on state administration and regulatory oversight by December 31, 2019”; and in said item by inserting after the words “the secretary of administration and finance”, the following:- “, the auditor,”.
