Direct Food Donations

Messrs. Fattman, Tarr and O'Connor moved that the proposed new text be amended by inserting after section _ the following section:-

SECTION XX. Section 328 of chapter 94 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting after the first paragraph the following:-

No food service entity or retail store who donates food, including open-dated food whose date has passed, directly to an individual without charge or at a charge sufficient only to cover the cost of handling such food, shall be liable for civil damages for any injury arising out of the condition of such food; provided, however, that at the time of donation such food is not misbranded and is not adulterated and has not been manufactured, process, prepared, handled or stored in violation of applicable regulations of the department of public health; and provided, further, that such injury is not the result of negligence, recklessness or intentional misconduct of the donor or any person employed by or under the control of the donor.

Welch and Lesser moved that the proposed new text be amended in section 2, in item 0330-0300, by adding the following words:- "; provided further, that not later than January 31, 2020, the trial court, in collaboration with the division of capital asset management and maintenance, shall submit a report to the secretary of administration and finance, the house and senate committees on ways and means and the joint committee on the judiciary that shall include, but not be limited to, a summary of all expenditures for the study, design, renovation or reconstruction of court facilities between fiscal year 1999 and fiscal year 2019, inclusive, delineated by county”.

Eldridge, Moore, Welch and Lesser, Ms. DiZoglio, Mr. Collins, Ms. Gobi, Mr. Tran and Ms. Lovely moved that the proposed new text be amended in section 2, in item 0337-0002, by inserting at the end thereof the following: “; provided further, that not less than $250,000 shall be expended on the Worcester County court-appointed special advocates program; provided further, that not less than $112,000 shall be expended on the Franklin and Hampshire County court-appointed special advocates program; provided further, that not less than $175,989 shall be expended on the Hampden County court-appointed special advocates program; provided further, that not less than $125,000 shall be expended on the Essex County court-appointed special advocates program; provided further, that not less than $200,000 shall be expended on the Boston court-appointed special advocates program; and provided further, that not less than $53,995 shall be expended on the Berkshire County court-appointed special advocates program" and in said item by striking out the figures "$22,017,779" and inserting in place thereof the figures "22,934,763".
