Floor Amendment

Ms. Garlick of Needham moves to amend the bill by striking out all after the enacting clause and inserting in place thereof the following:-

“SECTION 1. Chapter 55 of the acts of 2003 is hereby amended by inserting after section 11 the following section:-

Section 11A. The Hyannis Fire District of the town of Barnstable may collect an embarkation fee from the ferry services that operate in the Hyannis Fire District. The fee shall be $.25 per passenger per ticket sold for all passenger ferry trips to the islands of Nantucket or Martha’s Vineyard in the Hyannis Fire District. The Hyannis Fire District may establish a separate fund to be known as the Embarkation Fee Fund that shall be kept separate and apart from other revenues of the Hyannis Fire District by the treasurer of the Hyannis Fire District. Fees collected from passengers by the operator of the passenger ferry service departing and returning to the Hyannis Fire District ports shall be remitted to the commissioner of revenue. The commissioner shall deposit collected fees to the Embarkation Fee Fund of the Hyannis Fire District. Funds from the Embarkation Fee Fund shall be used for fire and public safety services provided by the Hyannis Fire District.

SECTION 2. This act shall take effect upon its acceptance by a majority vote of the Hyannis Fire District at an annual meeting of the district.”

and by striking out the title and inserting in place thereof the following title: “An Act relative to embarkation fees for the Hyannis Fire District.”.
