Amendment #28 to H3977

Supporting cultural organizations impacted by gambling

Mr. Fernandes of Falmouth moves to amend the bill in section 4, in section 16 of chapter 23N of the General Laws, by striking out the second sentence and inserting in place thereof the following sentence:- “The commission shall be the trustee of the fund and shall transfer monies from the fund as follows:

(1)  40 per cent to the Workforce Investment Trust Fund established in section 17;

(2)  28 per cent to the Gaming Local Aid Fund established in section 63 of section 23K;

(3)  20 per cent to the Youth Development and Achievement Fund established in section 18;

(4)  9 per cent to the Public Health Trust Fund established in section 58 of section 23K; and

(5)  1 per cent to the Players’ Benevolence Fund established in section 19; and

(6) 2 per cent to the Massachusetts Cultural and Performing Arts Mitigation Trust Fund, established in section 2HHHHH of chapter 29.”

And further amend the bill by inserting after section 4 the following 2 sections:

“SECTION 4A. The third sentence of subsection (a) of section 2HHHHH of chapter 29 of the General Laws, added in section 4 of chapter 142 of the acts of 2019, is hereby amended by striking out the words “and (iii)” and inserting in place thereof the following words:- (iii) monies transferred to the fund from the Sports Wagering Fund pursuant to sections 16 of chapter 23N; and (iv).

SECTION 4B. Subsection (b) of said section 2HHHHH of said chapter 29, as so appearing, is hereby amended adding the following sentence:- Notwithstanding the foregoing sentence, all monies deposited into the fund from the Sports Wagering Fund established pursuant to sections 16 of chapter 23N shall be dedicated to the organizational support program of the Massachusetts cultural council in full.”
