Amendment #1074 to H4000
Sexual Assault Evidence Kit Testing
Representatives Higgins of Leominster and Jones of North Reading move to amend the bill by adding the following new section:
SECTION XX. Section 2A of chapter 5 of the acts of 2019, as amended by chapter 142 of the acts of 2019, is hereby amended by striking out item 8100-1014 and inserting place thereof the following item:
8100-1014. For costs associated with the collection and testing of all previously untested investigatory sexual assault evidence kits, by the crime laboratory within the department of the state police or an accredited private crime laboratory designated by the secretary of public safety and security, within 180 days of the effective date of this act. The executive office of public safety and security shall issue a report, which shall be made publicly available on its website by January 1, 2022, which shall include (i) the number of untested investigatory sexual assault evidence kits in the possession of public crime laboratories prior to the effective date of this act; (ii) the year each kit was collected; (iii) the date each kit was tested; and (iv) the date the resulting information was entered into CODIS and the state DNA databases. For the purposes of this item, “previously untested investigatory sexual assault evidence kits” shall mean any sexual assault evidence kit or other evidence collected along with such kit that has not been through a forensic DNA analysis intended to develop an autosomal DNA profile that is eligible for entry into CODIS and the state DNA databases, prior appropriation continued.
