Amendment #747 to H4000

An Amendment to secure proper and equitable staffing for the Registries of Probate Division of the Probate and Family Court

Mrs. Harrington of Groton Ms. Harrington of Groton hereby moves to amend the bill by inserting after section 15 the following 17 sections:

 

“SECTION 15A. Section 23 of chapter 217 of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by striking out the third and fourth sentences and inserting in place thereof the following sentence:-

 

The appointments shall be as follows:

 

Barnstable, 1 first assistant register;

 

Berkshire, 1 first assistant register;

 

Bristol, 1 first assistant register;

 

Essex, 1 first assistant register;

 

Franklin, 1 first assistant register;

 

Hampden, 1 first assistant register;

 

Hampshire, 1 first assistant register;

 

Middlesex, 1 first assistant register;

 

Norfolk, 1 first assistant register;

 

Plymouth, 1 first assistant register;

 

Suffolk, 1 first assistant register;

 

Worcester, 1 first assistant register.

 

SECTION 15B. Said chapter 217 is hereby amended by striking out section 23A and inserting in place thereof the following section:-

 

Section 23A. In addition to the first assistant registers of probate provided for in section 23, the registers of the respective courts of the probate and family court department for the following counties may, with the approval of the chief justice of the probate and family court, appoint and remove assistant registers with the same powers and duties. The appointments shall be as follows:

 

Barnstable, 2 assistant registers;

 

Berkshire, 1 assistant register;

 

Bristol, 1 assistant register;

 

Essex, 2 assistant registers;

 

Franklin, 1 assistant register;

 

Hampden, 1 assistant register;

 

Hampshire, 1 assistant register;

 

Middlesex, 4 assistant registers;

 

Norfolk, 2 assistant registers;

 

Plymouth, 2 assistant registers;

 

Suffolk, 3 assistant registers;

 

Worcester, 2 assistant registers.

 

SECTION 15C. Section 23B of chapter 217 of the General Laws is hereby repealed.

 

SECTION 15D. Section 28 of said chapter 217, as appearing in the 2018 Official Edition, is hereby amended by striking out, in line 15, the figure “7.5” and inserting in place thereof the following figure:- 12.

 

SECTION 15E. Section 29 of said chapter 217, as so appearing, is hereby amended by striking out, in line 12, the figure “15” and inserting in place thereof the following figure:- 12.

 

SECTION 15F. Section 29A of said chapter 217, as so appearing, is hereby amended by striking out, in line 12, the figure “15” and inserting in place thereof the following figure:- 12.

 

SECTION 15G. Section 29B of said chapter 217, as so appearing, is hereby amended by striking out, in line 12, the figure “15” and inserting in place thereof the following figure:- 12.

 

SECTION 15H. Section 29C of said chapter 217, as so appearing, is hereby amended by striking out, in line 6, the words “of $6,000” and inserting in place thereof the following words:- in an amount equal to 12 per cent of the annual salary of the Barnstable county register of probate.

 

SECTION 15I. Section 29D of said chapter 217, as so appearing, is hereby amended by striking out, in line 6, the words “of $6,000” and inserting in place thereof the following words:- in an amount equal to 12 per cent of the annual salary of the Berkshire county register of probate.

 

SECTION 15J. Section 29E of said chapter 217, as so appearing, is hereby amended by striking out, in line 6, the words “of $6,000” and inserting in place thereof the following words:- in an amount equal to 12 per cent of the annual salary of the Hampden county register of probate.

 

SECTION 15K. Section 29F of said chapter 217, as so appearing, is hereby amended by striking out, in line 7, the figure “15” and inserting in place thereof the following figure:- 12.

 

SECTION 15L. Section 29G of said chapter 217, as so appearing, is hereby amended by striking out, in lines 6 and 7, the words “a salary of $6,000 per annum” and inserting in place thereof the following words:- additional compensation in an amount equal to 12 per cent of the annual salary of the Bristol county register of probate.

 

SECTION 15M. Section 29H of said chapter 217, as so appearing, is hereby amended by striking out, in line 7, the figure “15” and inserting in place thereof the following figure:- 12.

 

SECTION 15N. Section 29I of said chapter 217, as so appearing, is hereby amended by striking out, in line 7, the words “a salary of $6,000 per annum” and inserting in place thereof the following words:-

 

additional compensation in an amount equal to 12 per cent of the annual salary of the Plymouth county register of probate.

 

SECTION 15O. Section 29J of said chapter 217, as so appearing, is hereby amended by striking out, in line 7, the figure “15” and inserting in place thereof the following figure:- 12.

 

SECTION 15P. Section 29K of said chapter 217, as so appearing, is hereby amended by striking out, in line 7, the words “a salary of $6,000 per annum” and inserting in place thereof the following words:- additional compensation in an amount equal to 12 per cent of the annual salary of the Franklin county register of probate.

 

SECTION 15Q. Section 29L of said chapter 217, as so appearing, is hereby amended by striking out, in line 7, the figure “15” and inserting in place thereof the following figure:- 12.”

 

And moves to further amend the bill by inserting after section 28 the following 2 sections:-

 

“SECTION 28A. Notwithstanding any general or special law to the contrary, persons employed as deputy assistant registers of probate pursuant to sections 29, 29A, 29B, 29F, 29H, 29J and 29L of chapter 217 of the General Laws as of the effective date of this act shall receive additional compensation in an amount equal to 15 per cent of the annual salary of the register of probate for that county until such time as said persons are no longer employed as deputy assistant registers of probate for that county.

 

SECTION 28B. Notwithstanding section 15C or any other general or special law to the contrary, a person employed as an administrative deputy assistant register of probate pursuant to section 23B of chapter 217 of the General Laws as of the effective date of this act shall continue to be employed as an administrative deputy assistant register of probate and shall serve at the pleasure of the register of probate for that county.”
