Amendment #957 to H4000

EEC Private-Pay Rates

Ms. Peisch of Wellesley moves to amend the bill in section 2, in item 3000-1042, in line 11, by striking out the word “and”; and in said item by inserting at the end thereof the following words:- “;and provided further, that notwithstanding 808 CMR 1.03(4) or any other general or special law to the contrary, the department may allow a non-subsidized private center-based provider to charge a fair market rate for care to a private paying client where the fair market rate for care in the provider’s geographic market falls below the subsidized rate charged to the Commonwealth.”
