Amendment #777 to H4219

Disability Retiree COVID-19 Wage Relief

Mr. Vargas of Haverhill moves to amend the bill by adding the following section:

 

"Section XXXX. SECTION 1. Notwithstanding any general or special law to the contrary, an individual who retired under a general or special law on disability and earned in excess of the allowable amount described in subsection (b) of section 91 of chapter 32 of the General Laws for hours worked during the governor’s March 10, 2020 state of emergency shall not be required to refund such earnings.

SECTION 2. If, pursuant to subsection (c) of said section 91, an individual who retired under a general or special law on disability returned compensation to the appropriate treasurer or other person responsible due to earnings in excess of the allowable amount described in subsection (b) of said section 91 of said chapter 32 for hours worked during the governor’s March 10, 2020 state of emergency, the treasurer or responsible person shall refund the compensation.

SECTION 3. Notwithstanding section 91A of chapter 32 of the General Laws or any other general or special law to the contrary, an individual who retired under a general or special law on disability and earned in excess of the allowable amount described in said section 91A for hours worked during the governor’s March 10, 2020 state of emergency shall not be required to refund the individual’s pension or retirement allowance.

SECTION 4. If, pursuant to said section 91A of said chapter 32, an individual who retired under a general or special law on disability refunded a portion of the individual’s pension or retirement allowance due to earnings in excess of the allowable amount described in said section 91A for hours worked during the governor’s March 10, 2020 state of emergency, the pension or retirement allowance shall be repaid to the individual."
