An Act relative to Revere and Son Heritage Trust Corporation.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 3 of chapter 150 of the acts of 2020 is hereby amended by striking out subsection (d) and inserting in place thereof the following subsection:-

(d)(i) The corporation shall be a governmental body for the purposes of chapter 30B of the General Laws. Improvement of any property owned or leased by the corporation or leased by the corporation to another party, including design, development, construction and operation, shall be subject to sections 38A to 38O, inclusive, of chapter 7 of the General Laws, section 39M of chapter 30 of the General Laws and sections 44A to 44M, inclusive, of chapter 149 of the General Laws. For the purposes of clause Twenty-sixth of section 7 of chapter 4 of the General Laws and chapter 66 of the General Laws, the records of the corporation shall be public records. For the purposes of chapter 268A of the General Laws, the corporation shall be considered a municipal agency. The members of the board of directors and employees of the corporation and any person who performs professional services for the corporation on a part-time, intermittent or consultant basis, including architects, attorneys, engineers, planners, and construction, financial and real estate experts, shall be special municipal employees if so designated by the board of selectmen.

(ii) The corporation established in subsection (a) shall not be assessed any fee for a request made by the corporation for criminal offender record information or self-audit consistent with requests made by local government entities pursuant to section 172A of chapter 6 of the General Laws.

(iii) Notwithstanding any general or special law to the contrary, the corporation shall not be subject to section 58 of chapter 44 of the General Laws; provided, that the corporation shall be authorized to apply for and use alcohol licenses under section 14 of chapter 138 of the General Laws and shall be deemed to be a nonprofit charitable corporation organized under chapter 180 of the General Laws for the purposes of said section 14 of said chapter 138 and for the purpose of registering with the division of public charities in the department of the attorney general.

SECTION 2. This act shall take effect upon passage.
