The committee on Ways and Means, to whom was referred the Bill to permit the creation of a right-turn lane from Edgell Road to Central Street in Framingham (House, No. 4660), reports recommending that the Bill to permit the creation of a right-turn lane from Edgell road to Central street in the city of Framingham, ought to pass with an amendment substituting therefor the accompanying bill (House, No. 5095).

An Act to permit the creation of a right-turn lane from Edgell road to Central street in the city of Framingham.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General Laws or any general or special law to the contrary, the commonwealth shall change the purpose of certain land lying to the east of the layout of Edgell road in the city of Framingham, as laid out by the county commissioners under an order dated December 31, 1925, from land held open forever as a common for the benefit of the inhabitants of Framingham pursuant to a February 12, 1926 stipulation entered by the land court in Misc. Case No. 9340, registered as Document No. 72992 with the Middlesex south registry district of the land court, to permit the creation of a right-turn lane from Edgell road to Central street. Said land is shown as Parcel No. E-1 and consists of approximately 2,039 square feet on a plan titled “Exhibit Plan in Framingham Massachusetts”, prepared by VHB, Inc. for the city of Framingham, dated November 15, 2021, and on file with the Massachusetts Department of Transportation. Said creation of a right-turn lane is planned under Massachusetts Department of Transportation project #608889. Prior to finalizing the transaction herein, the city of Framingham may make minor modifications to the plan to carry out the purposes of this act.

SECTION 2. As consideration for the change of purpose of the land described in section 1, the city of Framingham shall transfer land of not less than 2,039 square feet to the conservation commission of the city of Framingham and shall dedicate said land for the purposes of conservation and passive recreation.

SECTION 3. The city of Framingham shall assume all costs associated with engineering, surveys, appraisals, preparation of instruments or documents to be recorded with the Middlesex south registry of deeds or filed with the registry district of the land court and other expenses deemed necessary by the Massachusetts Department of Transportation required to complete Massachusetts Department of Transportation project #608889.

SECTION 4. No instrument or document executed pursuant to this act shall be valid unless it provides that the area of land released from the purpose of such land held open forever as a common for the benefit of the inhabitants of Framingham, as set forth in section 1, shall be used solely for the purposes described in said section 1.

SECTION 5. This act shall take effect upon its passage.
