Mr. Michlewitz of Boston and others move to amend bill H.4700 in section 2, in item 1410-1616, as amended by Consolidated Amendment “A”, by inserting after the words “dogs for veterans”, the second time it appears, the following words:- ; provided further, that not less than $30,000 shall be expended for Gloucester World War II Memorial Fund to distribute $10,000 each to VFW Post 1624, AMVETS Post 32 and the Lester S Wass American Legion Post 3 on Cape Ann

 

And further amend said item by striking the figure “$5,157,822” as it appears in Consolidated Amendment “A” and inserting in place thereof the figure:- $5,187,822

 

And further amend the bill in section 2E, in item 1595-1068, by striking out the words "unless stated otherwise in this item,”

 

And further amend the bill in said item, 1595-1068, by striking out the words: "services provided during state or federal fiscal year 2022 or 2023 or for public hospital transformation and incentive initiative payments for state fiscal year 2022 or 2023 or for Medicaid care organization payments under 42 CFR 438.6(c) for rate year 2022 or 2023" and inserting in place thereof the following:- (i) services provided; (ii) public hospital transformation and incentive initiative payments; (iii) health equity incentive payments; or (iv) Medicaid care organization payments under 42 CFR 438.6(c); and in said item 1595-1068 by striking out the words: "which shall fully satisfy the non-federal share of such payment”

 

And further amend the bill in section 2E, in item 1595-6368, as amended by Consolidated Amendment “E” by inserting after the words “Wheeler road bridge” the following:- ; provided further, that not less than $1,000,000 shall be expended for the MBTA for the operation of a ferry service from Lewis Wharf Mall in East Boston to Long Wharf in the North End of Boston; provided further, that said ferry service shall run from April 1, 2022 to November 30, 2022; provided further, that the MBTA shall report on the number of passengers who utilize said service to the house and senate committees on ways and means not later than January 31, 2023

 

And further amend said item by striking out the figure “$393,705,240” as it appears in Consolidated Amendment “E” and inserting in place thereof the following figure:- $394,705,240

 

And further amend the bill in section 2E, in item 1595-6369, as amended by Consolidated Amendment “E” by inserting after the words “rail and commuter service” the following words:- ; provided further, that not less than $50,000 shall be expended for the installation of fire suppression systems at the Mattapoisett highway equipment facility

 

And further amend said item by striking the figure “$187,000,000” and inserting in place thereof the following figure:- $187,050,000

 

And further amend the bill in section 2, in item 2000-0101, as amended by Consolidated Amendment “F” by inserting after the words “snow removal vehicle” the following:- ; provided further, that not less than $50,000 shall be expended for the town of Rockport for coastal resilience planning and mitigation

 

And further amend said item by striking the figure “$5,075,000” as it appears in Consolidated Amendment “F” and inserting in place thereof the figure:- $5,125,000

 

And further amend the bill in section 2, in item 2330-0100, as amended by Consolidated Amendment “F” by inserting after the words “aforementioned counties” the following:- ; provided further, that not less than $195,000 shall be expended for Gloucester Marine Genomics Institute, Inc. for the development of a rapid test for the detection of harmful algal blooms

 

And further amend said item by striking out the figure “$8,498,813” as it appears in Consolidated Amendment “F” and inserting in place thereof the figure:- $8,693,813

 

And further amend the bill in section 2, in item 2511-0107, as amended by Consolidated Amendment “F” by inserting after the words “other stressors” the following:- ; provided further, that not less than $25,000 shall be expended for the Rice Sticks and Tea food pantry in the city of Boston

 

And further amend said item by striking out the figure “$775,000” as it appears in Consolidated Amendment “F” and inserting in place thereof the figure:- $800,000

 

And further amend the bill in section 2, in item 2810-0100, by inserting after the word “season” the following:- and that ice skating shall be available from September 1 through April 15 of the following year

 

And further amend the bill in section 2, in item 2810-0122, as amended by Consolidated Amendment “F” by inserting after the words “Depot road fields” the following:- ; provided further, that not less than $250,000 shall be expended for Wharf District Council Inc., for climate resilience planning; provided further, that not less than $50,000 shall be expended for lighting improvements to the Steriti Memorial rink on Commercial street in the city of Boston; provided further, that not less than $25,000 shall be expended for the DeFillipo playground in the city of Boston; provided further, that not less than $200,000 shall be expended for the construction of Fore River trail in Weymouth; provided further, that not less than $50,000 shall be expended for Friends of Crite Park Corp.

 

And further amend said item by striking out the figure “$3,655,000” as it appears in Consolidated Amendment “F” and inserting in place thereof the figure:- $4,230,000

 

And further amend the bill in section 2, in item 3000-1000, by inserting after the words “outreach to families” the following:- ; provided further, that not less than $100,000 shall be expended for More than Words in the city of Boston

And further amend said item by striking out the figure “$12,650,000” as it appears in Consolidated Amendment “B” and inserting in place thereof the following figure:- $13,000,000

 

And further amend the bill in section 2, in item 4510-0100, as amended by Consolidated Amendment “D” by striking out the words “; provided further, that not less than $30,000 shall be expended for the Matt Brown Foundation, Inc. in Norwood to support individuals and families living with or recovering from illness or injury, with a particular emphasis on those living with or recovering from spinal cord injuries”

And further amend said item by striking out the figure “$6,110,000” as it appears in Consolidated Amendment “G” and inserting in place thereof the figure:- $7,195,000

 

Moves to amend the bill in section 2, in line item 7053-1925, by striking out the word “lunches” and inserting in place thereof the following word:- meals.

 

And further amend the bill in section 2, in item 7066-0000, as amended by Consolidated Amendment “A” by inserting after the words “College, Inc” the following:- ; provided further, that not less than $50,000 shall be expended for the city of Quincy in collaboration with Friends of Faxon Park for improvements to Faxon park; provided further, that not less than $100,000 shall be expended for student supports at Quincy College

And further amend said item by striking out the figure “$2,763,250” as it appears in Consolidated Amendment “C” and inserting in place thereof the following figure:- $3,093,250

 

And further amend the bill in section 3 by striking out the words “distributed from said item 7061-0008” and inserting in place thereof the following:- distributed from said items 7061-0008 and 7061-0009

 

And further amend said section 3 by striking out the words “, as defined in section 2 of said chapter 70,”

 

And further amend said section 3 by striking out the words “the higher of: (a) the number of students identified as economically-disadvantaged by qualifying as a match in the commonwealth’s direct certification system; or (b) the district’s fiscal year 2016 low-income percentage multiplied by its current foundation enrollment” and inserting in place thereof following:- determined by financial eligibility for certain federal programs, as defined by the provisions of section 2 of said chapter 70, and including a number of students identified and approved as low income through the supplemental claiming system established and posted by the department for that purpose, as well as students identified and approval as homeless for purposes of calculating the McKinney-Vento homelessness grant program administered by the department, consistent with the conditions provided for in said section 2.

 

And further amend said section 3 by striking out the word “actual”

 

And further amend said section 3 striking out the words “as reported to the department of elementary and secondary education”

 

And further amend said section 3 striking the out word “one sixth” and inserting in place thereof:- two-sixths

 

And further amend said section 3 by striking out the words “Foundation budget rates for employee benefits and fixed charges, guidance and psychological services, special education out-of-district tuition, English learners and low-income students shall be increased by one-sixth of the gap between the fiscal year 2022 rates and the target rates established by said chapter 70 and shall be set as identified in the tables below” and inserting in place thereof the following:- Foundation budget rates for employee benefits and fixed charges, guidance and psychological services, special education out-of-district tuition, English learners and low-income students shall be increased by two-sixths of the gap between the rates used in fiscal year 2021 and the rates established in tables 1 and 2 of section 3, of said chapter 70, consistent with adjustments prescribed in the provisions of said section 3, and set at the rates identified in the table below.

 

And moves to further amend the bill in section 17 by inserting after the figure “(c)”, in line 264, the following words:- ; provided, however, that no payment from the fund shall be for any financial incentive received in connection with a communication services contract, including, but not limited to a commission.

 

And moves to further amend the bill by inserting after section 45 the following section:-

 

SECTION 45A. Section 5 of chapter 349 of the acts of 1986, as amended by section 132 of chapter 33 of the acts of 1991, is hereby further amended by adding the following subsection:-

 

(c) Notwithstanding the provisions of this act or any other general or special law to the contrary, any portion of the park to be constructed pursuant to this act that is leased by the authority for a period of not less than 99 years to an entity wholly owned by a nonprofit corporation organized for conservation purposes or for the preservation of open space, the construction of such park and the improvements to be located thereon by such nonprofit corporation pursuant to such lease shall not constitute a public works pursuant to section 39M of chapter 30 of the General Laws or a building project or construction of a building by a public agency for purposes of sections 44A through 44H, inclusive, of chapter 149 of the General Laws; provided, that the prevailing wage law pursuant to sections 26 to 27H, inclusive, of chapter 149 of the General Laws shall apply.

 

And moves to further amend the bill in section 53 by adding the following subsection:-

 

(c) Notwithstanding any general or special law to the contrary any financial incentive received in connection with a voice communication services or other communication services contract, including, but not limited to a commission, shall revert to the General Fund.
