Amendment #744 to H4700

Nuclear Power Plant Assessment

Representatives Muratore of Plymouth, LaNatra of Kingston and Xiarhos of Barnstable move to amend the bill, by inserting the following 4 sections after section 27:-

SECTION 27A. Section 5K of chapter 111 of the General Laws, as  appearing in the 2020 Official Edition, is hereby amended by striking out, in line 65, the words "existing and proposed".

SECTION 27B. Said section 5K of said chapter 111, as so appearing, is hereby further amended by inserting, in line 66, after the word "commonwealth" the following words:- , including a nuclear power plant that is no longer operating, until the U.S. Nuclear Regulatory Commission has approved all areas of the site for unrestricted use, excluding the Independent Spent Fuel Storage Installation licensed by the U.S. Nuclear Regulatory Commission, and the unrestricted use areas meet the radiological release criteria established in regulations promulgated pursuant to section 5N. Such assessments shall be.

SECTION 27C. Subsection (E) of said section 5K of said chapter 111, as so appearing, is hereby further amended by striking out the second and third sentences.

SECTION 27D. Said section 5K of said chapter 111, as so appearing, is hereby further amended by striking out, in lines 91 and 92, the words "General Fund and credited to the department" and inserting in place thereof the following words:- Radiation Control Trust account.
