Massachusetts Rental Voucher Program

Mr. Madaro of Boston moves to amend the bill in section 2, in item 7004-9024, in the thirty-third line, by striking out the words “provided further, that notwithstanding any general or special law to the contrary, each household holding a voucher shall pay at least 30 per cent, but not more than 40 per cent, of its income as rent except that the household payment in any project-based unit that is subsidized under another federal or state subsidy or public housing program shall be subject to applicable limits on tenant paid rent under such federal or state program and except that households receiving tenant-based assistance under this section may pay more than 40 per cent of the monthly adjusted net income of the household, as their option; provided further, that this amount may not exceed 40 per cent of the monthly adjusted net income of the household in the first year of occupancy” and inserting in place thereof the following words: “provided further, that notwithstanding any general or special law to the contrary, for 12 months following recertification for mobile vouchers issued before July 1, 2022, or for each voucher at the first year of occupancy, each household holding a voucher shall pay no more than 30 per cent of its income as rent, including the amount allowed for tenant paid utilities, as determined by the department; provided further that at the first annual redetermination after enactment of this budget, households with mobile vouchers under this section may, at their option, pay for rent and utilities up to 40 percent of the monthly net income of the household; provided further that the household payment in any project-based unit that is subsidized under another federal or state subsidy or public housing program shall be subject to applicable limits on tenant paid rent under such federal or state program”; and in the seventy-first line, by striking out the words “provided further, that the department's approved monthly rent limits for mobile vouchers shall not be less than the current areawide fair market rent based on unit size as established annually by the United States Department of Housing and Urban Development” and inserting in place thereof the following words: “provided further, that the tenant based assistance for mobile vouchers issued or leased on or after July 1, 2022, shall use a  payment standard determined by the Department that shall not be less than 100 percent or exceed to 110 percent of the area or small area fair market rent based on unit size as established annually by the United States Department of Housing and Urban Development; provided further that, in circumstances as determined by the Department, the payment standard may exceed 110 percent of the fair market rent; provided further that such circumstances may include, but not be limited to, the need for a higher payment standard to assist households to find housing outside areas of high poverty, to assist households who have trouble finding housing for lease, and to assist households when needed as a reasonable accommodation for persons with disabilities”.
