Amendment #23 to H4790

Replacing Lead Service Lines in Environmental Justice Communities

Mr. Livingstone of Boston moves to amend the bill in section 2C, in item 0640-1005, in line number 11, by inserting after “waste”, the following:

“;provided further that, (a) Notwithstanding chapter 29C of the General Laws, sections 16 of chapter 275 of the acts of 1989 or any other general or special law to the contrary, to provide an adequate supply of safe drinking water, the department of environmental protection shall develop a pilot program, to be administered by the Clean Water Trust through the Drinking Water Resolving Fund established in said chapter 29C, Section 2QQ to provide grants to municipalities that contain an Environmental Justice Population in Massachusetts for replacement of lead service line pipes for the Environmental Justice Population area. Not less than $20,000,000 should be expended to the Clean Water Trust to apply amounts appropriated to the Drinking Water Revolving Fund under paragraph (a) of said section 16 of said chapter 275 and any investment earnings thereon. Grants for replacement of lead service pipes shall constitute drinking water projects for the purposes of said chapter 29C, Section 2QQ. (b) For the purposes of this Section, “Environmental Justice (EJ) Population” means (A) a neighborhood that meets 1 or more of the following criteria: (i) the annual median household income is not more than 65 per cent of the statewide annual median household income; (ii) minorities comprise 40 per cent or more of the population; (iii) 25 per cent or more of households lack English language proficiency; or (iv) minorities comprise 25 per cent or more of the population and the annual median household income of the municipality in which the neighborhood is located does not exceed 150 per cent of the statewide annual median household income; or (B) a geographic portion of a neighborhood designated by the Secretary as an environmental justice population in accordance with law (c) For the purposes of this Section, “lead service lines” shall have the same meaning as 40 CFR Part 141, as amended. (d) All applications for grants for the replacement of lead service lines shall be subject to section 127B½ of chapter 111 of the General Laws.”, and in said item by striking out the figures $64,000,000” and inserting in place thereof the figures “$84,000,000”.
