Mr. Day of Stoneham moves to further amend amendment #12 by striking out the amendment in its entirety and inserting in place thereof the following:-

Mr. Day of Stoneham moves to amend the bill by inserting after section 9 the following section:-

SECTION 9A. Section 12K of chapter 112 of the General Laws, as so appearing, is hereby amended by adding the following definition:-

“Severe”, as determined by an individual’s physician consistent with the principles of medical ethics and the regulations promulgated by the department of public health as required by section 12N.

And further moves to amend the bill in section 11 by inserting after the word “section”, in line 203, the following words:- ; provided, that the department shall consult with a member of the disability community selected by the department and the Arc of Massachusetts; the Massachusetts Medical Society or a designee, Planned Parenthood League of Massachusetts or a designee; the Massachusetts Health and Hospital Association, Inc. or a designee; and an impacted individual previously forced to travel out of state for an abortion after 24 weeks.

And further moves to amend the bill by adding the following section:-

SECTION 43. The department of public health shall provide provisional guidance on section 12N of chapter 112 of the General Laws within 30 days of the effective date of this act.
