Amendment #2 to H5105
Regulating Class 3 Electric Bicycles
Representatives Fernandes of Falmouth, Roy of Franklin, Owens of Watertown, Higgins of Leominster and Garballey of Arlington move to amend the amendment in section 1, in line 34, by inserting after the words “effective date” the following words:
“(i) Class 3 electric bicycles shall be subject to the following additional regulations:
(1) No person under the age of 16 may operate a class 3 electric bicycle. A person under the age of 16 may ride as a passenger on a class 3 electric bicycle that is designed to accommodate passengers.
(2) All operators and passengers of class 3 electric bicycles shall wear a properly fitted and fastened bicycle helmet that meets the standards provided by either the United States Consumer Product Safety Commission or the American Society for Testing and Materials, or standards subsequently established by those entities. A violation of this clause shall not be used as evidence of contributory negligence in a civil action.
(3) All class 3 electric bicycles must be equipped with a speedometer that displays the speed the bicycle is traveling in miles per hour.”
and in section 2, in line 42, by inserting after the words “20 miles per hour” the second time they appear the following words:
““Class 3 electric bicycle” , an electric bicycle or tricycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provide assistance when the bicycle reaches the speed of 28 miles per hour.”
and by striking out section 3 and inserting in place thereof the following:
“SECTION 3. Said section 1 of said chapter 90, as so appearing, is hereby further amended by inserting after the definition of “Department” the following definition:-
“Electric bicycle”, a bicycle or tricycle equipped with fully operable pedals and an electric motor of 750 watts or less that meets the requirements of a class 1 electric bicycle, a class 2 electric bicycle or a class 3 electric bicycle.”
