Student Financial Literacy

Mr. O'Connor moves that the proposed new text be amended by adding the following sections:-

SECTION XX. Section 1Q of Chapter 69 of the General Laws, as so appearing, is hereby amended by striking paragraph (b) and replacing it with the following:-

"(b) A school district, charter school, approved private day or residential school or collaborative school shall incorporate the financial literacy standards established pursuant to section 1D and subsection (a) into existing curriculum including, but not limited to, mathematics, history and social sciences, technology or business."

SECTION XX. Chapter 71 of the General Laws is hereby amended by adding the following new section:-

"Section 98. (a) In all public schools, financial literacy shall be taught as required subjects to promote an understanding of personal finances and financial stability. Instruction shall include (i) loans; (ii) interest and interest accrual; (iii) credit card debt; (iv) online commerce; (v) rights and responsibilities of renting or buying a home; (vi) saving, investing and planning for retirement; (vii) the role of banking and financial services; (viii) balancing a checkbook; (ix) state and federal taxes; (x) charitable giving; (xi) evaluating media content, including online content, that relates to personal finance matters; and (xii) saving, investing and planning for higher education or professional training."

SECTION XX. The department may apply for federal, state or other funding, including funding available through the Economic Empowerment Trust Fund established pursuant to section 35QQ of chapter 10 to implement the provisions of sections XX and XX of this act.

Student Financial Literacy

SECTION XX. Chapter 29 of the General Laws is hereby amended by inserting after section 2CCCCC the following section:-

Section DDDDD. There shall be established and set up on the books of the commonwealth a separate fund to be known as the Financial Literacy Trust Fund. The fund shall be administered by the commissioner of elementary and secondary education. The fund shall be credited with: (i) revenue from appropriations or other money authorized by the general court and specifically designated to be credited to the fund; (ii) interest earned on such revenues; and (iii) funds from public and private sources such as gifts, grants and donations to further financial education and professional development. Amounts credited to the fund shall not be subject to further appropriation and any money remaining in the fund at the end of a fiscal year shall not revert to the General Fund.

(b) Annually, not later than October 1, the commissioner shall report to the clerks of the house of representatives and senate, the joint committee on education and the house and senate committees on ways and means on the fund's activity. The report shall include, but not be limited to: (i) the source and amount of funds received; (ii) the amounts distributed and the purpose of expenditures from the fund, including but not limited to, funds expended to assist school districts in implementing financial literacy (iii) any grants provided to institutions of higher education and other stakeholder organizations; and (iv) anticipated revenue and expenditure projections for the next year.

SECTION XX. Section 2 of chapter 438 of the acts of 2018 is hereby amended by striking the word ‘1P’ and inserting in place thereof the following word:- 1Q.

SECTION XX. Said section of said chapter, as so appearing, is hereby further amended by striking the word ‘1Q’ and inserting in place thereof the following word:- 1R.

SECTION XX. Said section of said chapter, as so appearing, is hereby further amended by striking out, in subparagraph B, the word ‘may’ and inserting in place thereof the following word:- shall.

SECTION XX. Section 1 and section 4 of this act shall take effect one full academic year from enactment.

Higher Education Retirement

“SECTION XX. Section 18A of chapter 15 of the General Laws, as so appearing, is hereby amended by inserting after paragraph 4 the following paragraph:- “The board of higher education, hereinafter referred to as the “board”, may establish, administer, and operate plans intended to comply with the provisions of section 403(b) of the Internal Revenue Code of 1986, as amended. Such plans will be maintained for the exclusive benefit of plan participants and their beneficiaries. Eligible employees, as determined by the provisions of each plan, may include employees of the executive office of education; the department of higher education; the department of elementary and secondary education; the department of early education and care; the state universities; the state community colleges; and any other department identified by the secretary of education that meets the requirements of an eligible employer under said section 403(b) of the Internal Revenue Code. The sole source of contributions to the plans shall be employees’ elective contributions. Where applicable and appropriate, the commonwealth shall remit such contributions to the provider selected by the participant from those providers identified by the board as plan providers. Those plan providers identified by the board may offer annuity and/or custodial accounts meeting the requirements of said section 403(b) of the Internal Revenue Code. Investments of plan contributions shall be directed by the participant. The board may promulgate regulations governing the administration of and participation in the plans.”

 

SECTION XX. Section 22C of said chapter 32 of the General Laws, as so appearing, is hereby amended by striking the words “the employer contribution to the optional retirement program under section 40 of chapter 15A;” and inserting in place thereof, the following words:- “ the administrative costs of the deferred compensation plan operated by the board of higher education authorized by section 18A of chapter 15, and the employer contributions and administrative costs of the optional retirement program authorized by section 40 of chapter 15A;”.
