Prohibiting Self-Dealing by Pharmacy Benefit Managers and Pharmacies Under Common Ownership

Ms. Creem moves that the proposed new draft be amended in line 935 by striking the word "record" and inserting in place thereof the following:- "record.

Section 4. A health benefit plan or pharmacy benefit manager shall not penalize, require, or provide financial incentives, including variations in premiums, deductibles, copayments, or coinsurance, to insureds as incentives to use a specific retail pharmacy, mail order pharmacy, or other network pharmacy provider in which the pharmacy benefit manager has an ownership interest or that has an ownership interest in the pharmacy benefit manager".
