Collegiate Sports

Messrs. Gomez, Collins and O'Connor move that the proposed new text be amended in Section 8, in line 129, subsection (2), by striking paragraph 23 in its entirety and inserting in place thereof the following:- 

“Sporting event”, a professional sport or athletic event, collegiate sport, motor race event or other event authorized by the commission under this chapter; provided, however, that “sporting event” shall not include: (i) electronic sports; or (ii) amateur sports or athletic events including, but not limited to, high school and youth sports or athletic events or Olympic sports or athletic events.

In Section 8, in line 131, subsection (2), by striking paragraph 22 in its entirety and inserting in place thereof the following:-

“Sports governing body”, a sports organization that has a regulatory, sanctioning or organizing function for a specific sporting event including, but not be limited to, a professional sports organization as defined in 28 U.S.C. 3701(3), a national governing body as defined in 36 U.S.C. 220501(b)(9), and any collegiate sports governing body such as the National Collegiate Athletic Association.; and

In Section 8, in line 136, subsection (2), by striking paragraph 26 in its entirety and inserting in place thereof the following:-

“Sports wagering”, the business of accepting wagers on sporting events or portions of sporting events, the individual performance statistics of athletes in any collegiate sport or athletic event or any combination thereof by any system or method of wagering approved by the commission  including, but not limited to, a mobile application or other digital platform; provided, however, that “sports wagering” shall include, but not be limited to, single-game bets, teaser bets, parlays, over-under, moneyline, pools, exchange wagering, in-game wagering, in-play bets, proposition bets and straight bets; provided further, that “sports wagering” shall not include the acceptance of a wager on injuries, penalties, player discipline or replay review; and provided further, that “sports wagering” shall not include fantasy contests as defined in section 11M½ of chapter 12.
