Ms. Rausch moves that the proposed new draft be amended in section 14, in line 293, by striking out the figure “2” and inserting in place thereof the following figure:- "3"; and
further in said section 14, after line 319, by inserting the following new paragraph:-
“Section 21. Enrollment in an early education and care program shall be subject to the provisions of section 15 of chapter 76. Each early education and care provider shall annually report to the departments of early education and care and public health the total number of enrolled children who are vaccinated against the spread of infectious diseases, consistent with generally accepted medical practice, and the total number of enrolled children who are exempt from immunization requirements, delineated by exemption type. A privately owned or operated early education and child care provider may limit vaccination exemptions to medical exemptions only; provided, that the provider creates and maintains a written immunization policy, which shall be made available to the department of early education and care, the department of public health, parents or guardians of currently enrolled children, and parents or guardians of prospectively enrolled children; and provided further, that no provider shall refuse to accept a child’s medical exemption to vaccination requirements. The department of public health shall designate the methodology for reporting vaccination and exemption data as set forth herein. The department of public health shall annually publish immunizations and exemptions data, delineated by exemption type, for each provider; provided, the department may also publish data by municipality, county, or other geographic designation, or otherwise in its discretion; provided further, that publication shall be electronic and may also be in hard copy; and provided further, that publication shall not be required whenever doing so would result in disclosure of personal information as defined in section 1 of chapter 93H or otherwise violate applicable privacy laws.”
