Foreclosure Prevention - Improving HAF
Messrs. Gomez and Eldridge, Ms. Gobi, Messrs. Velis and Hinds, Ms. Lovely and Ms. Comerford moved that the proposed new text be amended in section 2, by adding the following item:- "XXXX-XXXX......To provide for the Massachusetts Housing Partnership to cover mortgage arrears arising before January 2020 and non-mortgage arrears, including but not limited to property tax, utility costs, homeowners association fees and home insurance, regardless of mortgage delinquency status; provided further, that all mortgage servicers or their agents , concurrent with the Service members Civil Relief Act pleading, any notices given pursuant to G.L. c. 244, sec. 35A and 35B; and any notice of sale given pursuant to G.L. c. 244, sec. 14, must deliver a notice about the federal Homeowner Assistance Fund and the benefits available under this provision, including a description of the Massachusetts programs, the website address and phone number where homeowners can find information about and apply for assistance, and the name and phone number of the administrator of the programs; and provided further, that no servicer shall initiate or proceed with foreclosure activity for 90 days upon receipt of notification that the homeowner has applied for Federal Housing Assistance Fund benefits or benefits under this provision...........$50,000,000".
