Ms. Moran and Messrs. Cyr, Pacheco, O'Connor and Moore moved that the proposed new text be amended by inserting after section X the following 3 sections:-

“SECTION XX. Said section 5K of said chapter 111, as so appearing, is hereby further amended by striking out, in lines 91 and 92, the words “General Fund and credited to the department” and inserting in place thereof the following words:- Radiation Control Trust account.”.

SECTION XX. Section 5K of chapter 111 of the General Laws is hereby amended by inserting the following new sections:

Section X. Notwithstanding any general or special law to the contrary, an owner or affiliate of a nuclear power station, including decommissioned facilities, seeking to discharge materials from spent fuel pools, including processed water, from said nuclear power station into Cape Cod Bay shall provide a sample of said materials prior to said discharge and a description of discharge to an independent third party as designated by the department.

(1) Description of the discharge shall include the method, location, frequency, anticipated dates of discharge, and any other information the department or independent third-party requests.

(2) The independent third party shall submit the result of the review to the department and include a recommendation on the safety and potential impacts of such discharge.

(3) The department shall post said results and recommendations publicly on the department’s website.

(4) No such materials shall be discharged into Cape Cod Bay until the review has been completed and the department has publicly issues said report and recommendation.

Section X. The said owner or affiliate shall reimburse The Radiation Control Trust account for all costs to the department and independent third party for said review.

Section X.  The department shall reimburse the independent third party for all costs incurred for said review.

Section X. This section shall take effect immediately.”.
