Conservation Land Tax Credit

Messrs. Tarr, Moore, Hinds and Pacheco, Ms. Moran, Mr. Cronin, Ms. Gobi and Messrs. Eldridge, Fattman, Gomez, O'Connor, Timilty and Brady moved that the proposed new text be amended by inserting after section _ the following sections:-

SECTION 1. Subsection (p) of section 6 of chapter 62 of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by adding, in line 769, after the words “as amended” the following words:- “, or private nonprofit trust compliant with chapter 203 organized for the purposes of land conservation, which is authorized to do business in the commonwealth, and which has tax-exempt status as a nonprofit charitable organization as described in Section 501(c)(3) of the Internal Revenue Code of 1986, as amended.

SECTION 2. Said subsection (p) of said section 6 of said chapter 62, as so appearing, is hereby amended by striking out, in line 835, the figure “$2,000,000” and inserting in place thereof the following figure:- “$3,000,000”.

Section 38AA of chapter 63, as so appearing, is hereby amended by adding, in line 29, after the words “as amended” the following words:- , or a private nonprofit trust compliant with chapter 203 organized for the purposes of land conservation, which is authorized to do business in the commonwealth, and which has tax-exempt status as a nonprofit charitable organization as described in Section 501(c)(3) of the Internal Revenue Code of 1986, as amended.

SECTION 6. Said section 38AA of said chapter 63, as so appearing, is hereby amended by striking out, in line 88, the figure “$2,000,000” and inserting in place thereof the following figure:- “$3,000,000”.

SECTION 7. Said section 38AA of said chapter 63, as so appearing, is hereby amended by striking out, in line 88, the figure “$3,000,000” and inserting in place thereof the following figure:- “$4,000,000”.

SECTION 8. Said section 38AA of said chapter 63, as so appearing, is hereby amended by striking out, in line 88, the figure “$4,000,000” and inserting in place thereof the following figure:- “$5,000,000”.

SECTION 9. Sections 2 and 6 shall take effect on January 1, 2022.

SECTION 10. Sections 3 and 7 shall take effect on January 1, 2023.

SECTION 11. Sections 4 and 8 shall take effect on January 1, 2024.

SECTION 12. Sections 2, 3, 4, 6, 7, and 8 of this act shall expire on December 31, 2031.

Quarry Testing Requirements to Prevent Against Pyrrhotite

Ms. Gobi, Ms. Comerford, Ms. Rausch and Messrs. Lesser, Fattman, Feeney, Moore, Gomez, O'Connor, Timilty and Montigny moved that the proposed new text be amended by inserting after section 14 the following section:-

“SECTION 14A. Chapter 21B of the General Laws is hereby amended by adding the following section:-

Section 16. (a) For the purposes of this section, the following words shall have the following meanings unless the context clearly requires otherwise:

“Aggregate”, granular materials such as gravel, sand and crushed rock that are combined for a particular purpose.

“Certified geologist”, a professional geologist certified by the American Institute of Professional Geologists.

“Concrete aggregate”, natural sand, natural gravel or crushed aggregate products produced from ledge rock.

(b) Any person seeking to mine, expand, excavate or otherwise operate a quarry for the purpose of producing concrete aggregate for sale or use in foundations, structural elements or infrastructure such as roadways and bridges shall submit to the commissioner and the state geologist an application for a license to conduct such quarry activity.

Each license application shall consist of: (i) a description of the geographic location of the quarry; (ii) a quarry operations plan, including, but not limited to, mining, processing, storage and quality control methods; (iii) a geological source report, consistent with subsection (c); and (iv) the results of aggregate testing for the presence of pyrite or pyrrhotite, consistent with subsection (d). Each license application shall be accompanied by a fee in an amount to be determined by the commissioner. Fees received by the department under this section shall be used to implement this section; provided, however, that any surplus fee receipts shall be deposited into the General Fund.

(c) The geological source report required in subsection (b) shall be prepared by a certified geologist in a form and manner prescribed by the commissioner, in consultation with the state geologist and a representative nominated by the Massachusetts Concrete and Aggregate Producers Association, and shall include, but not be limited to: (i) a description of the characteristics of the aggregate to be excavated at the subject quarry; (ii) a description of the products to be produced by such quarry; (iii) a copy of the results of an inspection of face material and geologic log analysis conducted not more than 60 days from the date of the report; and (iv) petrographic analyses of grab or core samples representative of the material being mined.

(d) Aggregate testing to identify the presence of pyrite or pyrrhotite required in subsection (b) shall include, but not be limited to, a total sulfur test to measure total sulfur content in a representative sample. Aggregate testing shall be performed by an accredited laboratory in accordance with applicable standards established by American Society of Testing and Materials international standards or alternate standards to be determined by the commissioner in consultation with the state geologist.

(e) The commissioner or a designee, in consultation with the state geologist, shall review each license application submitted pursuant to this section and notify each applicant whether the license has been approved and any applicable conditions of operation. If the application is denied, the notification shall include the reason for denial. A license granted under this section shall be valid for 1 year from the date of approval; provided, however, that a geological source report prepared under subsection (c) shall be valid for a period of 4 years from the date of preparation; and provided further, that aggregate test results demonstrating a total sulfur content of less than 0.1 per cent by mass shall be valid for a period of 4 years from the date of testing. A license shall not be approved if the total sulfur content is not less than 1 per cent by mass. If the total sulfur content is equal to or greater than 0.1 per cent by mass but not more than 1 per cent by mass, the license shall be denied unless the state geologist, in the state geologist’s sole discretion, recommends approval to the commissioner consistent with applicable American Society of Testing and Materials international standards. The state geologist may require additional testing or information to justify an approval recommendation.

(f) A person owning or operating a quarry subject to licensure pursuant to this section shall maintain all records relevant to such licensure and quarry operation, including, but not limited to, a record of the aggregate source in concrete batches, for not less than 30 years.

(g) The commissioner, in consultation with the state geologist, shall catalogue and maintain the quarry data collected under this section.

(h) Nothing in this section shall prohibit a municipality from requiring permits for quarry operation or excavation or from establishing pyrite and pyrrhotite presence restrictions that are more stringent than those set forth in this section.

(i) Nothing in this section shall affect the operations of quarries producing aggregate for purposes other than those described in subsection (b).

(j) The department, in consultation with the state geologist, shall promulgate regulations to implement this section.”; and

by inserting after section 72 the following section:-

“SECTION 72A. Section 16 of chapter 21B shall be effective on December 31, 2022; provided, however, that entities licensed to operate a quarry in the commonwealth before the effective date of this act that are affected by section 16 of chapter 21B of the General Laws shall meet the requirements of said section 16 of said chapter 21B not later than December 31, 2022; provided further, that any work conducted by such an entity prior to December 31, 2022 shall comply with existing regulations.”.

Quarry Testing Requirements to Prevent Against Pyrrhotite

Ms. Gobi, Ms. Comerford, Ms. Rausch and Messrs. Lesser, Fattman, Feeney, Moore, Gomez, O'Connor and Timilty moved that the proposed new text be amended by inserting after section __ the following three sections:-

“SECTION XX. Section 2 of chapter 21B of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by inserting after the definition of 'Abandoned workings' the following 2 definitions:-

'Aggregate', granular materials such as gravel, sand and crushed rock that are combined for a particular purpose.

'Certified geologist', a professional geologist certified by the American Institute of Professional Geologists.

SECTION XX. Said chapter 21B is hereby further amended by adding the following section:-

Section 16. No license shall be approved under this section if the total sulfur content is equal to or greater than 1 per cent by mass. If the total sulfur content is equal to or greater than one-tenth per cent by mass but less than 1 per cent by mass, the license shall be denied unless the state geologist, in their sole discretion, recommends approval to the commissioner consistent with applicable ASTM International standards. The state geologist may require additional testing or information to justify an approval recommendation.

(e) A person owning or operating a quarry subject to licensure pursuant to this section shall maintain all records relevant to such licensure and quarry operation, including, but not limited to, a record of the aggregate source in concrete batches, for not less than 30 years.

SECTION XX. Existing entities currently licensed in the commonwealth and affected by this section shall come into compliance with the language set forth not later than December 31st, 2022. All work done until that time must comply with existing regulations.".

Inland Fisheries and Game Fund

Ms. Gobi, Messrs. Fattman, Moore, Tarr and Pacheco, Ms. Moran, Mr. Cronin, Ms. Rausch and Messrs. Hinds, Gomez, O'Connor and Timilty moved that the proposed new text be amended in section 2, in item 2300-0100, by adding the following words:- “; provided further, that the Inland Fisheries and Game Fund shall be reimbursed annually from the General Fund for all lost revenue attributed to the issuance of discounted or free hunting and fishing licenses”.

Wildlife Habitat Management through sale of conservation stamps

Ms. Gobi and Messrs. Moore, Tarr, Timilty, Cronin, Fattman and O'Connor moved that the proposed new text be amended by inserting after section __ the following 2 sections:-

"SECTION X. Section 2A of Chapter 131 of the Massachusetts General Laws, as appearing in the 2018 Official Edition, is hereby amended by striking the section in its entirety and inserting in place thereof the following:-

Section 2A. There is hereby established within the Inland Fisheries and Game Fund, a wildland acquisition account which shall be credited monies received from the sale of wildland conservation stamps, the portion of the fees for sporting, fishing, trapping and hunting licenses to be credited under the provisions of section 2C, contributions thereto and any grant monies from the federal government or other public and private sources.

Said account, subject to appropriation, shall be used only for the purchase of land containing wildlife habitat and for costs directly related to the administration of the wildlands stamp program.

Two dollars and fifty cents from the sale of wildlands conservation stamp shall be dedicated to habitat management on lands managed by the division of fisheries and wildlife.

The director may contract with the seller of wildlands for installment payments provided that the total of all such installment payments does not exceed seventy-five percent of the previous year's income to the wildlands acquisition account. Acquisition of all lands so purchased shall be made with the advice and consent of the fisheries and wildlife board. All such lands shall be acquired exclusively for protection and management of wildlife habitat and shall be available for fishing, trapping, and hunting.

SECTION XX. Section 13A of Chapter 131 of the Massachusetts General Laws, as appearing in the 2018 Official Edition, is hereby amended by striking the section in its entirety and inserting in place thereof the following:-

Section 13A. Except as hereinafter provided, no person shall fish, trap, or hunt in the commonwealth, or utilize any lands managed by the division of fisheries and wildlife without first having obtained a wildlands conservation stamp, which shall be issued by the director or his duly authorized agent upon the payment of seven dollars and fifty cents; provided, however, that persons who are exempted from licensing requirements need not purchase such a stamp; provided, further, that persons issued fishing, sporting, trapping, or hunting licenses without charge shall be issued said stamp without charge; and provided, further, that no person who has purchased a stamp with any current resident license to fish, trap, or hunt shall be required to pay the fee for a wildlands conservation stamp for any additional current license or any duplicate license. The director is hereby authorized to issue stamps in such form as he may prescribe and may issue rules and regulations necessary for the implementation of this section. The stamp may be imprinted directly on fishing, sporting, trapping, or hunting licenses or issued separately at the discretion of the director."

Use of Crossbows for Hunting

Ms. Gobi, Messrs. Moore, Fattman and Pacheco, Ms. Moran and Messrs. Cronin and O'Connor moved that the proposed new text be amended by inserting after section __ the following 2 sections:-

SECTION X. Section 64 of chapter 131 of the General Laws is hereby amended by striking out, in lines 2 and 3, the words “or an crossbow, except as provided in section 69,”

SECTION XX: Said chapter 131 is hereby amended by striking out section 69 and inserting in place thereof the following section:

Section 69: A person shall not carry or use a bow and arrow, or a crossbow or a bolt or arrow with a crossbow, while hunting unless said bow and arrow, or said crossbow and bolt or arrow, meet the requirements of the rules and regulations which shall be promulgated by the director. Such rules and regulations shall prescribe the general design, weight of pull, and type of bows and arrows, and type of crossbows, and bolts and arrows, and shall conform to standards generally accepted for hunting purposes. No person shall use a crossbow for hunting with any projectile, other than a bolt or arrow that meets the applicable requirements as established under this section.”

SECTION X. “Section 58 of chapter 131 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by inserting, in line 6, after the word "thereof" the following words:- ", provided that a person may hunt with a bow and arrow not less than 250 feet from any dwelling in use except as authorized by the owner or occupant thereof".

Sunday Bow Hunting

Ms. Gobi, Messrs. Fattman and Pacheco, Ms. Moran and Mr. Cronin moved that the proposed new text be amended by inserting after section __ the following section:-

SECTION X. “Section 57 of chapter 131 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by adding the following sentence:- This section shall not prohibit the director, with the approval of the fisheries and wildlife board, from authorizing hunting with archery equipment on any Sunday on privately owned lands, lands under the care, custody and control of the Department of Fish and Game, and lands under the care, custody and control of the Department of Conservation and Recreation’s Office of Watershed Management, and shall not render unlawful the possession or carrying of archery equipment for the purpose of hunting on a Sunday, as authorized by the director with the approval of the fisheries and wildlife board”.

(a) There shall be established and set up on the books of the commonwealth a separate fund to be known as the Revere Beach Reservation Trust Fund to be used, without further appropriation, by the secretary of energy and environmental affairs for the long-term preservation, maintenance, nourishment and public safety of Revere Beach in the city of Revere. Any balance in the fund at the end of the fiscal year shall not revert to the General Fund but shall remain available for expenditure in subsequent fiscal years. No expenditure made from the fund shall cause the fund to become deficient at any point during a fiscal year. Annually, not later than October 1, a report shall be filed with the clerks of the house of representatives and the senate and the house and senate committees on ways and means that shall include projects undertaken, expenditures made and income received by the fund.

(b) Not less than 50 per cent of the revenues collected by the department of conservation and recreation from parking stations installed on or after January 1, 2021 and not less than 50 per cent of the revenues generated through parking violations within the Revere Beach Reservation shall be deposited into the Revere Beach Reservation Trust Fund. Expenditures by the trust shall be used for capital improvements to Revere Beach Reservation.

Annually, not later than November 30, the department of conservation and recreation shall meet with the mayor of the city of Revere to discuss the maintenance and safety plan for the beach for the next calendar year as well as the balance and expenditures from the Revere Beach Reservation Trust Fund.”.

Sustaining natural and working lands

"SECTION_. Chapter 21N is hereby amended by inserting at the following new section:-SECTION 12. (a) The executive office of energy and environmental affairs shall develop policies, programs, grants, loans and incentives to meet the statewide natural and working lands goal as identified in the plan, including, but not limited to, a communities for a sustainable climate program. The executive office of energy and environmental affairs shall apply and disburse monies and revenues as provided in this section.

(b) The secretary shall establish a communities for a sustainable climate program. The purpose of the program shall be to provide technical and financial assistance, including incentives, grants and loans, to municipalities that qualify as sustainable communities under this section. These incentives, grants and loans shall be used to finance all or a portion of the costs of designing, constructing and implementing actions and strategies to reduce greenhouse gas emissions and increase carbon sequestration on natural and working lands.

(c) To qualify as a community for a sustainable climate, a municipality or other local governmental body shall comply with eligibility requirements developed by the secretary or his designee. Eligibility requirements are intended to incentivize communities to adopt policies and practices that protect, enhance, and restore carbon stocks on natural and working lands beyond business as usual. The secretary shall set eligibility requirements from among, but not limited to, the following: (1) adopt a municipal tree retention and replacement by-law or ordinance; (2) adopt natural resource protection zoning, as defined by the secretary; (3) collect a reasonable fee to be used exclusively for measures to remedy and offset the generation of greenhouse gases caused by activities that convert forest, wetlands, and agricultural lands for development at a size and scale determined by the secretary; (4) adopt a municipal transfer of development rights by-law or ordinance; and (5) adopt and implement a municipal procurement policy for municipal purchasing and substituting wood products for municipal operations and assets, where feasible, including but not limited to, concrete and steel in buildings. The secretary may waive specified requirements based on a written finding that, due to unusual circumstances, a municipality cannot reasonably meet the requirements and that the municipality has committed to alternative measures that advance the purposes of the communities for a sustainable climate program as effectively as adherence to the requirements. The Secretary may adopt alternative eligibility requirements that provide opportunities to achieve the goals of the program.

(d) The secretary may develop policies to provide for consistency and predictability and to help offset the impacts of municipal ordinances and by-laws upon the private sector under the communities for a sustainable climate program that may be adopted by participating communities, including, but not limited to, grants, loans, incentives and tax credits and expedited permitting for practices and strategies consistent with the goals to reduce greenhouse gas emissions and increase carbon sequestration on natural and working lands.

(e) Funding for the communities for a sustainable climate program in any single fiscal year shall be available, without the need for further appropriation, from sources including, but not limited to: (1) the global warming solutions trust fund established in section 35GGG of chapter 10 of the general laws; and (2) land management and restoration grant, loan and incentive programs administered by the executive office of energy and environmental affairs."

(a) The litter prevention and cleanup task force shall include 1 or more designees appointed by the secretary of the department of transportation, one of whom shall serve as Chair, the executive director of the Massachusetts office of travel and tourism or a designee, the secretary of public safety and security or a designee, the secretary of energy and environmental affairs or a designee, and the Executive Director of Keep Massachusetts Beautiful.

(b) The litter prevention and cleanup task force shall create a consistent, memorable, Massachusetts-themed anti-littering slogan, and branding, and develop a litter prevention advertising campaign across multiple platforms including but not limited to television and radio broadcast, print, social media, state-controlled messaging boards, billboards, and signs. The task force shall conduct an analysis on the annual costs associated with the cleanup of highway and roadside litter, the funding sources currently used for litter cleanup, and the areas most impacted by litter. The task force shall consider the current enforcement and fine statutes and regulations related to littering in the Commonwealth.

(c) The litter prevention and cleanup task force shall issue a report with recommendations on potential funding needed for litter cleanup along our highways and roadsides, recommendations related to litter enforcement among motorists and vehicles with improperly covered loads, including but not limited to, best practices for law enforcement, whether additional funding is needed for enforcement, and whether the current fine structure is adequate. The report shall be filed by December 31, 2023 with the Governor of the Commonwealth, the clerks of the House of Representatives and Senate, the Chairpersons of the Joint Committee on Transportation, the Chairpersons of the Joint Committee on Tourism, Arts, and Cultural Development, and the Chairpersons of the Joint Committee on Environment, Natural Resources and Agriculture.

(d) The department of transportation shall allocate funding in line item xxxx-xxxx in a manner consistent with the final recommendations of the litter prevention and cleanup task force.”

Notwithstanding any general or special law to the contrary, subject to availability of sufficient proceeds, the department of energy resources shall expend amounts from the RGGI Auction Trust Fund established in section 35II of chapter 10 of the General Laws to fund the green communities program established in section 10 of chapter 25A of the General Laws, electric vehicle incentive programs through June 30, 2024 and transportation sector electrification programs through June 30, 2024; provided, however, that the department of energy resources shall offer rebates of not less than $2,500 and not more than $5,000 for the purchase or lease of battery electric vehicles, fuel cell electric vehicles and zero-emissions vehicles for sale or lease with a retail price of not more than $50,000. All payments made from the fund before June 30, 2024 shall be prioritized so that the initial payments from the fund shall be made to the green communities, electric vehicle incentive and transportation electrification programs; provided, however, that not less than $27,000,000 shall be available for electric vehicle incentive programs per fiscal year; provided further, that the department shall examine the programs, including, but not limited to, the cost-effectiveness of the programs in greenhouse gas emissions reductions, and report its findings to the joint committee on telecommunications, utilities and energy not later than October 1, 2022; provided further, that the department, with the approval of the secretary, may allocate funds sufficient to reimburse the commonwealth for the direct costs incurred in its administration of the RGGI program; and provided further, that not later than October 1, 2022, the department shall itemize said reimbursements in a report to the joint committee on telecommunications, utilities and energy.

(J) programs that result in customers switching to renewable energy sources or other clean energy technologies; and (K) programs for customers to adopt energy efficiency and full building strategic electrification measures through the efficiency and load management programs under subsection (b)(2)(iv)(A) and to install onsite renewable energy generation or install onsite renewable energy generation paired with energy storage in order to lower energy consumption, reduce demand, improve customer resiliency, or otherwise enable customers to reduce use of the distribution system, provided that the renewable energy generation funded hereunder is designed as a qualifying facility as defined in 220 CMR 8.02;".

Access to Green Energy

“SECTION 55A. (a) Notwithstanding any general or special law to the contrary, not later than January 1, 2024, any electric distribution company or municipal aggregator with a certified efficiency plan may submit proposed low and moderate-income whole building efficiency, electrification and greenhouse gas emission reduction offerings to a limited number of participants within the low and moderate income customer groups to the department of public utilities for review. The offerings shall: (i) promote the adoption of whole building energy efficiency measures, including weatherization; (ii) require full displacement of fossil fuel heating and cooling equipment and fossil fuel cooking appliances, excluding outdoor grills; and (iii) promote adoption and installation of onsite renewable energy generation and energy storage. A renewable energy facility funded by the offerings made under this section shall be designated as a “qualifying facility” as defined in 220 CMR 8.02. The offerings shall be designed to encourage customers to lower energy consumption, reduce demand, improve customer resiliency or reduce use of the distribution system.

(b) Costs incurred under this section may be recovered through the funding sources authorized by subsection (a) of section 19 of chapter 25 of the General Laws.

(c) Not later than August 1, 2028, the department shall file a report detailing the results of the offerings under this section, including: (i) an analysis of costs, benefits and scalability of the offerings; and (ii) recommendations for legislative changes to any energy efficiency and renewable energy generation incentive programs. The report shall be filed with the clerks of the senate and the house of representatives, the joint committee on telecommunications, utilities and energy and the house and senate committees on ways and means.”.

Deep Energy Retrofit Fund

“SECTION XX. Chapter 23J of the General Laws is hereby amended by adding the following section: -

‘Section 15. (a) There shall be established and set up on the books of the commonwealth a separate fund known as the Deep Energy Retrofit Fund to be administered by the center.

(b) The center shall make expenditures from the fund for the purpose of providing grants to fund deep energy retrofits.

(c) The fund's activity shall be included in the annual report required by section 5. The center shall also annually file, no later than October 1 and at least 30 days prior to the expenditure of any funds, a plan detailing the planned uses of funds in the upcoming calendar year with the joint committee on telecommunications, utilities and energy and the house and senate committees on ways and means; provided, however, that in the development of this plan, the center shall hold at least 1 public hearing to solicit stakeholder feedback.

(d) On the effective date of this act, the comptroller shall transfer no less than $45,000,000 from the General Fund to the Deep Energy Retrofit Fund established in this section for the purpose of carrying out this act. Any money remaining in the fund at the end of a fiscal year shall not revert to the General Fund.’”

Protecting research animals

Messrs. Tarr, O'Connor, Montigny and Moore moved that the proposed new text be amended by inserting after section _ the following:-

SECTION 1. Chapter 140 of the General Laws is hereby amended by inserting after Section 174D the following section:-

(a) Section 174D1/2. As used in this section, the following words shall have the following meanings, unless the context clearly requires otherwise:

“Animal rescue organization”, an organization whose mission and practice is the placement of abandoned, unwanted, neglected or abused animals, that does not obtain dogs or cats from a breeder or broker for payment or compensation and that is an organization exempt from taxation under section 501(c)(3) of the federal Internal Revenue Code or corresponding sections of that code.

“Animal shelter”, a facility operated, owned or maintained by an animal rescue organization that exists for the purpose of receiving, maintaining, caring for, transporting or transferring ownership of a domestic animal, but not a foster home.

“Product testing facility”, a facility that is engaged in animal research for the testing of consumer products.

“Research Facility”, a higher education research facility that utilizes dogs or cats for educational, medical or scientific research that receives public funds or a facility that provides research through a contractual agreement with a higher education research facility

(b) A research facility or product testing facility shall, after the completion of any testing or research involving a dog or cat that does not require euthanasia of the animal upon the termination of the study as defined and approved by the research or testing protocol, assess the health of the animal and determine whether the animal is suitable for adoption. Except as otherwise provided in subsection (c), a research facility or product testing facility that intends to euthanize a dog or cat shall, before euthanizing the dog or cat, make a reasonable effort to offer the dog or cat for adoption to an individual, an animal shelter or an animal rescue organization for the purpose of facilitating the adoption of said dog or cat to a permanent adoptive home. A research facility or product testing facility may enter into a collaborative agreement with an individual, an animal shelter or an animal rescue organization for the purpose of carrying out the provisions of this subsection. A research facility, product testing facility, animal shelter or animal rescue organization involved with the adoption of a dog or cat used for research or testing shall make reasonable efforts to adhere to the principles of (i) facilitating permanent adoptions and discouraging post-adoption transfers, (ii) selecting adopters for willingness and ability to keep the animal permanently, provide an appropriate living space and accept lifelong responsibility for the animal’s care; and (iii) ensuring that collaboration with an individual, an animal shelter or an animal rescue organization should only occur after careful review of the entity’s mission statement (if an animal shelter or an animal rescue organization), reputation, history of involvement with animal adoption and criminal history.

(c) A research facility or product testing facility is not required to offer a dog or cat to an individual, animal shelter or rescue organization pursuant to subsection (b) if the dog or cat: (i) manifests a behavioral or medical defect that poses a risk to the health and safety of the public; or (ii) manifests symptoms of a disease, injury, congenital or hereditary condition that adversely affects, or is likely to adversely affect, the health of the dog or cat. The attending veterinarian of the research facility or product testing facility or designee shall be responsible for assessing the suitability of the dog or cat and determining its availability for adoption under this section.

(d) A facility that is required to offer dogs and cats for adoption under this section shall owe no duty of care to an animal shelter or rescue organization that accepts the animal or to a person or entity that adopts those animals, whether through the organizations or through private placement. No assumption of responsibility or liability for injuries, property damage or other damages or losses shall be incurred by a research institution or product testing facility on account of the adoption or placement of a dog or cat pursuant to the provisions of this act.

(e) Nothing in this act shall require a research institution or product testing facility to offer a dog or cat for adoption to an animal shelter, rescue organization or through private placement if the dog or cat is a newborn dog or cat in need of maternal care and not appropriate for adoption.
