"SECTION XX.  Section 7 of chapter 161A of the General Laws, as amended by section 19 of chapter 29 of the acts of 2021, is hereby further amended by striking out subsection (a) and inserting in place thereof the following subsection:-

(a) The authority shall be governed and its corporate powers exercised by a board of directors. The board shall consist of: the secretary, who shall serve ex officio; 1 person to be appointed by the mayor of the city of Boston; 1 person to be appointed by the advisory board who shall have municipal government experience in the service area constituting the authority and experience in transportation operations, transportation planning, housing policy, urban planning or public or private finance; and 6 persons to be appointed by the governor, 1 of whom shall have experience in safety, 1 of whom shall have experience in transportation operations, 1 of whom shall have experience in public or private finance, 1 of whom shall be a rider as defined in section 1 and a resident of an environmental justice population as defined in section 62 of chapter 30, 1 of whom shall be a municipal official representing a city or town located in the area constituting the authority, as defined in section 1 of chapter 161A and 1 of whom shall be selected from a list of 3 persons recommended by the president of the Massachusetts State Labor Council, AFL-CIO".

Orange Line Extension

"SECTION XX. Notwithstanding any general or special law to the contrary, the Massachusetts Department of Transportation shall conduct a feasibility study relative to extending rapid transit service from the current terminus of the Massachusetts Bay Transit Authority’s Orange Line at Oak Grove in the City of Malden to the Massachusetts Bay Transit Authority Rail station through Roslindale Village, in the Roslindale section of the city of Boston.

SECTION XX. The study shall examine and evaluate the costs and economic opportunities related to extending Orange Line service or otherwise expanding rapid transit service from the City of Malden to the City of Boston, including but not limited to: (i) the projected capital costs; (ii) the projected operating costs and revenue estimates; (iii) the projected ridership levels; (iv) the prospect of operating on existing rights of way and other operational issues; (v) the environmental and community impact estimates; (vi) the availability of federal, state, local and private sector funding sources; (vii) regional equity in rapid transit investments in the commonwealth, and (viii) the potential economic, social and cultural benefits to the Boston Neighborhoods and the commonwealth as a whole.

SECTION XX. The department shall file the report with the clerks of the house and senate, the chairs of the house and senate committee on ways and means and the senate and house chairs of the joint committee on transportation not later than 120 days after passage of this act."

Fiscal Year 2023 Regional Transit Authority Funding Distribution

Brady and Cronin, Ms. Gobi, Ms. Rausch, Mr. Hinds, Ms. Lovely and Messrs. Timilty and Pacheco moved that the proposed new text be amended in section 3, by striking the text of Section 57, and inserting in place thereof: 

 

“SECTION 57. Notwithstanding any special or general law to the contrary, for fiscal year 2023, of the $103,500,000 transferred in item 1595-6370 of section 2E, $94,00,000 shall be considered operating assistance and distributed to regional transit authorities based on fiscal year 2022 distributions, in accordance with the fiscal year 2022/23 bilateral memorandum of understanding between each regional transit authority and the Massachusetts Department of Transportation; provided, however, that each regional transit authority shall receive operating assistance from this item of not less than the amount received in fiscal year 2022; and provided further, $7,000,000 of said operating assistance shall be distributed to each regional transit authority using a formula based on total transit ridership, the population of its member communities and service coverage area, provided that the formula be agreed to by all regional transit authorities and approved by the department. The operating assistance amount shall be provided to advance the goals and targets of workforce development and service.

Of the amount to be transferred under said item 1595-6370 of said section 2E, no less than $2,500,000 shall be distributed by the Massachusetts Department of Transportation as grants to regional transit authorities to design and implement means-tested, discounted or fare free pilot programs that provide discounted or no-fee transit fares to qualifying riders on all modes of transportation operated by each authority; provided further that the Massachusetts Department of Transportation shall distribute all grants before September 1, 2022.

In developing a means-tested, discounted or fare-free program, each regional transit authority shall engage in a fare review process as determined by federal regulation, providing opportunities for public input in geographically-diverse service areas of the authority and prioritizing engagement with environmental justice populations as defined in section 62 of chapter 30. The review process shall include, but not be limited to, an examination of: (i) the number of riders anticipated to benefit from the program; (ii) the average reduction of each fare, by mode; (iii) the overall impact on revenue to the system; (iv) partnership models for determining eligibility requirements and the verification method; (v) any estimated costs associated with the administration and marketing of the program; and (vi) consideration of a no-fare option if that would be cheaper to implement than a means-tested fare program.

During the operation and upon completion of the means-tested, discounted or fare-free pilot program, the Regional Transit Authority council, in coordination with the secretary of health and human services, shall conduct an evaluation of the program. The evaluation shall include, but not be limited to, an examination of: (i) the number of riders who participated in the pilot program and anticipated to benefit from a permanent program; (ii) the number of rides by participants of the program by mode and geographic information on the origination and destination of trips (iii) the overall impact on revenue to the system;  (iv) partnership models for determining eligibility requirements and the verification method; and (v) any estimated costs associated with the administration and marketing of the program. The Regional Transit Authority council shall make publicly available and file an evaluation and a comprehensive report on the entire program upon completion of the program with the clerks of the senate and house of representatives, the senate and house committees on ways and means and the joint committee on transportation not later than July 1, 2023.”

Timilty and Pacheco moved that the proposed new text be amended in section 2, in item 1595-6370, by striking out the words “innovative low-income fare reduction” and inserting in place thereof the following:- “means-tested, discounted or fare-free”; and

by striking out section 57 and inserting in place thereof the following section:-

“SECTION 57. (a) Notwithstanding any special or general law to the contrary, for fiscal year 2023, of the $96,500,000 transferred in item 1595-6370 of section 2E, $94,00,000 shall be considered operating assistance and distributed to regional transit authorities based on fiscal year 2022 distributions, in accordance with the fiscal year 2022/23 bilateral memorandum of understanding between each regional transit authority and the Massachusetts Department of Transportation.  Each regional transit authority shall receive operating assistance from said item 1595-6370 of said section 2E of not less than the amount received in fiscal year 2022. (b) Of the amount to be transferred under item 1595-6370 of section 2E, $2,500,000 shall be distributed as grants to regional transit authorities to design and implement means-tested, discounted or fare-free pilot programs that provide discounted or no-fee transit fares to qualifying riders on all modes of transportation operated by each authority. The Massachusetts Department of Transportation shall distribute all grants not later than September 1, 2022.

Mr. Feeney and Ms. Rausch moved that the proposed new text be amended in section 2E, by adding the following words:- "; provided further, that the Massachusetts Bay Transportation Authority shall expend funds for construction and upgrades at the South Attleboro commuter rail station to ensure the complete reopening of the station for commuter rail and commuter service".
