Protecting Junior Operators

Messrs. O'Connor and Tarr moved that the proposed new text be amended by adding the following section:-

"SECTION XX. Notwithstanding any general or special law to the contrary, there is hereby established a special commission to study laws and regulations relevant to junior operator licenses and vehicle safety for minors with the goal of increasing driver safety and reducing instances of traffic fatalities. Topics of consideration shall include, but not be limited to, (i) further deterrents from operating a vehicle unlawfully, (ii) prohibiting junior operators from carrying passengers in vehicles, (iii) increasing penalties for roadway violations, (iv) additional driver’s education and training hours, and (v) continuing education for junior operators.

The special commission shall consist of: the secretary of the executive office of public safety and security, or their designee, who shall serve as chair; the secretary of the department of transportation, or their designee; the registrar of motor vehicles, or their designee; the president of the senate, or their designee; the minority leader of the senate, or their designee; the speaker of the house of representatives, or their designee; the minority leader of the house of representatives, or their designee; and an instructor of a drivers education program, to be appointed by the Governor. The commission shall report their findings, along with any recommendations for legislation, to the chairs of the joint committee on public safety and homeland security no later than December 1, 2023."

AEDs in Emergency Vehicles

Messrs. O'Connor, Keenan, Tarr, Collins, Timilty, Hinds and Moore moved that the proposed new text be amended by inserting the following sections:-

"SECTION XX. Chapter 29 of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by inserting after 2ZZZZ the following section:-

Section 2ZZZZ. There shall be established and set upon the books of the commonwealth a separate fund to be known as the Automatic External Defibrillator Trust Fund. The secretary of public safety and security shall administer the fund and make expenditures from the fund in the form of grants to municipalities for the purchase of automated external defibrillators for public safety and first responder vehicles. The fund shall be credited with: (i) any revenue from appropriations or other monies authorized by the general court and specifically designated to be credited to the fund; (ii) any gifts, grants, private contributions or investment income earned on the assets of the fund; and (iii) revenues, not more than $1,000,000 in a calendar year.  Any money in the fund at the end of a fiscal year shall not revert to the General Fund but shall remain available for expenditure in subsequent fiscal years. The secretary shall annually, not later than December 31, report on the activity of the fund to the clerks of the senate and house of representatives and the senate and house committees on ways and means.

SECTION XX. Chapter 33 of the General Laws, as so appearing, is hereby amended by inserting after section 7E the following section:-

7E1/2. Any on duty motor vehicle owned or operated by a city or town police or fire department in the commonwealth and used for official business shall be equipped with at least one fully functioning AED, as defined in section 12V1/2 of chapter 112.

SECTION XX. Section 35E7/8 of chapter 90 of the General Laws, as inserted by section 3 of chapter 137 of the acts of 2018, is hereby amended by inserting after subsection (a) the following subsection:-

(b) There shall be a public safety vehicle equipment surcharge of $0.50 imposed upon each vehicular rental transaction in the commonwealth. The surcharge shall be in accordance with section 32E3/4 and shall be deposited in the Automatic External Defibrillator Trust Fund established in section 2WWWW of chapter 29; provided, however, that not more than $1,000,000 collected from the surcharge in a calendar year be deposited into the fund; and provided further, that any amount collected from the surcharge above $1,000,000 in a calendar year shall be deposited into the General Fund. The surcharge shall not apply to transportation network companies or to rental periods of less than 24 hours that are charged on an hourly basis."

Prison Phone Calls

Ms. Creem, Ms. Comerford, Ms. Rausch, Mr. Eldridge, Ms. Chang-Diaz, Messrs. Barrett, Brady and Hinds, Ms. Edwards, Mr. Gomez, Ms. Jehlen and Ms. Lovely moved that the proposed new text be amended by inserting after section 41 the following sections:-

“SECTION 41A. Chapter 127 of the General Laws is hereby amended by inserting after section 87 the following section:-

Section 87A. (a) For the purposes of this section, the terms “county correctional facility”, “state correctional facility” and “state prison” shall have the same meanings as in section 1 of chapter 125.

(b) The department of correction and the sheriffs shall provide and ensure adequate infrastructure to provide voice communication services, including phone calls, to persons incarcerated or detained in state correctional facilities, state prisons and county correctional facilities.

(c) The department of correction and the sheriffs shall provide voice communication services, including phone calls, free of charge to every inmate and the receiving party and each inmate shall have access to voice communication services for the maximum number of minutes  to the extent that such access does not interfere with rehabilitative, educational or vocational programming or routine facility procedures.

(d) The department of correction and the sheriffs may supplement voice communication services with other communication services including, but not limited to, video and electronic communication services; provided, however, that other communication services shall not replace voice communication services; and provided further, that other communication services shall be provided free of charge to the inmate and receiving party.

(e) Nothing in this section shall authorize or permit the department of correction or sheriffs to limit or prohibit in-person visits, except in accordance with safety and public health considerations.

(f) Notwithstanding any general or special law to the contrary, a state or local law enforcement agency shall not receive revenue, financial incentives or commissions from the provision of communication services, including, but not limited to, voice, video and electronic communications services, to any person confined in a state correctional facility, state prison or county correctional facility.

(g) The department of correction and each county sheriff shall report to the clerks of the senate and house of representatives quarterly the number of phone call minutes used, the number of phone call minutes allowed daily and the reasons for any limitations on access.

SECTION 41B. Said chapter 127 is hereby further amended by adding the following section:-

Section 170. (a) For the purposes of this section, the terms “county correctional facility”, “state correctional facility” and “state prison” shall have the same meanings as in section 1 of chapter 125.

(b) State correctional facilities, state prisons, county correctional facilities and entities contracting with such facilities, shall not charge more than 3 per cent over the purchase cost for commissary items. The department of correction and county sheriffs shall maximize discounts procured from bulk purchasing of commissary items or other contracting opportunities that reduce the cost of such items and shall not receive commissions, revenue or other financial incentives in any contract with a seller, supplier or vendor of commissary items. Commissary items offered shall include gender affirming items, consistent with section 32A of chapter 127, and culturally appropriate items for all communities in custody.”; and

by inserting after section 72 the following section:-

“Section 72A. (a) Notwithstanding any general or special law to the contrary, not later than July 1, 2023, any provision of a contract for communication services to any person confined in a state correctional facility, state prison or county correctional facility that provides for the payment of revenue, financial incentives or commissions to a state or local law enforcement agency shall be void and the department of correction and sheriffs shall renegotiate any such contract to remove any such provision. A renegotiated contract shall reduce the cost of communication services to reflect the removal of any provision that provide for the payment of revenue, financial incentives or commissions to a state or local enforcement agency; provided, however, that no other terms of the contract shall be affected by this section or section 87A of chapter 127 of the General Laws; provided further, that the department of corrections and the sheriffs shall seek to maximize purchasing power and consolidate contracts to the extent feasible after such renegotiated contracts expire.

(b) Any service, benefit or program for incarcerated people to which commissary commissions were specifically designated in fiscal year 2022, including, but not limited to, the Inmate Benefit Fund, The Law Library and the Central Program Account in the state prison system, shall be funded by the department of correction and the sheriffs at not less than the level of funding in fiscal year 2022."; and

SECTION XX. Chapter 127 of the General Laws is hereby amended by inserting after section 87 the following section:-

Section 87A. (a) For the purposes of this section, the terms “state correctional facilities”, “state prisons” and “county correctional facilities” shall have the same meanings as those terms are defined in section 1 of chapter 125.

(b) The department of correction and sheriffs shall provide and shall ensure adequate infrastructure to provide voice communication services, including phone calls to persons committed to state correctional facilities, state prisons and county correctional facilities, including jails and houses of correction pursuant to this section.

(c) The provision of such communication services, including phone calls shall be provided free of charge to the person initiating and the person receiving the communication, and each person shall have access to such services for the maximum feasible period of time each day.

(d) The department of correction and sheriffs may supplement voice communication services with other communication services, including, but not limited to, video and electronic communication services provided, however, that other communication services shall not replace voice communication services; and provided further, that other communication services shall be provided free of charge to the person initiating and the person receiving the communication and that such services shall be maximized to the extent possible.

(e) Nothing in this section shall authorize or permit the department of correction or sheriffs to limit or prohibit in-person contact visits.

 

SECTION YY. (a) Notwithstanding any general or special law to the contrary, after June 30, 2023 no state or local agency shall receive revenue, financial incentives or commissions from the provision of voice communication services or any other communication services to any person confined in a state or local correctional or detention facility.

(b) Notwithstanding any general or special law to the contrary, after June 30, 2023 any provision of a voice communication services contract or other communication services contract, including but not limited to video and electronic communication services, that provides for the payment of revenue, financial incentives or commissions shall be deemed void and for any contract containing such a provision in force on the effective date of this act, the renegotiated contract shall reduce the cost of communication services to the department of corrections or sheriff to reflect the removal of such provision, provided that no other terms of the contract shall be affected by this section or section XX of this Act; and provided further, that voice communication services shall be free of charge to the person initiating and the person receiving the communication on July 1, 2023, and that that other communication services offered pursuant to section 87A of chapter 127, including, but not limited to, video and electronic communication services shall be offered free of charge to the person initiating and the person receiving the communication on July 1, 2023 .

(c) Notwithstanding any general or special law to the contrary, the department of corrections and each sheriff not later than July 1, 2023 shall renegotiate and amend the terms of existing contracts providing voice communication and other communication services and provided further that upon the expiration of such renegotiated contracts, the department of corrections and the sheriffs shall seek to maximize purchasing power and consolidate contracts to the extent feasible.

SECTION ZZ.  Section XX of this act shall become effective on July 1, 2023

Police Officer Recruitment and Retention Study

"SECTION XX . (a) There shall be a commission to study the current status of police officer retention and recruitment in the commonwealth and issues relating to maintaining a sufficient, qualified and diverse policing workforce that is reflective of the commonwealth’s population. The commission shall consist of: the chairs of the joint committee on public safety and homeland security, who shall serve as co-chairs; the chairs of the joint committee on racial equity, civil rights, and inclusion; the secretary of public safety and security or a designee; the secretary of labor and workforce development or a designee; the executive director of the municipal police training committee; 1 member appointed by the minority leader of the senate; 1 member appointed by the minority leader of the house of representatives; 3 members appointed by the governor, 1 of whom shall be a police officer below the rank of sergeant, 1 of whom shall be a police officer at or above the rank of lieutenant with experience in personnel issues and 1 of whom shall be a retired judge who has served in the commonwealth; 3 members appointed by the attorney general, 1 of whom shall be an attorney with experience in in law enforcement related matters, 1 of whom shall be an attorney with experience in civil rights and 1 of whom shall be from a community-based organization; 1 member appointed by the Massachusetts peace officer standards and training commission; 1 member appointed by the Massachusetts Chiefs of Police Association, Inc., who shall be a police chief in the commonwealth; 1 member appointed by the co-chairs who shall have expertise in psychology; 1 member appointed by the co-chairs who shall have expertise is sociology; 1 member appointed by the secretary of education, who shall have experience in the education of those pursuing careers in law enforcement; 1 representative of the Massachusetts Association of Minority Law Enforcement Officers, Inc.; 1 representative of the Massachusetts Criminal Justice Reform Coalition; and 1 representative of the ACLU Foundation of Massachusetts, Inc..

(b) The study shall include an examination of factors that may affect recruitment and retention including, but not limited to: (i) the rigors of the job; (ii) the suitability of training; (iii) psychological barriers; (iv) any obstacles to the recruitment and retention of police officers who belong to historically underrepresented communities or demographics; and (v) any social, economic or other factors.

(c) The committee shall conduct not less than 3 public hearings at geographically diverse locations across the commonwealth and shall accept written testimony.

(d) Not later than April 2, 2024, the committee shall file a report on its findings,  including any legislative recommendations, with the clerks of the senate and house of representatives, the joint committee on public safety and homeland security, the joint committee on the judiciary, the joint committee on labor and workforce development, the joint committee on racial equity, civil rights, and inclusion and the senate and house committees on ways and means.

Preventing Social Media Use & Video Recordings While Driving

Mr. Montigny moved that the proposed new text be amended by inserting after section ___ the following section:-

“SECTION ___.  Section 13 of Chapter 90 of the General Laws is hereby amended by striking out in lines 27-31 the following words:-

No person shall drive any motor vehicle equipped with any television viewer, screen or other means of visually receiving a television broadcast which is located in the motor vehicle at any point forward of the back of the driver’s seat, or which is visible to the driver while operating such motor vehicle.”; and

by inserting after section ___ the following section:-

“SECTION __. Subsection (a) of section 13B of chapter 90 of the General Laws is hereby amended by inserting after the third sentence the following sentence:-

No operator of a motor vehicle shall use a mobile electronic device to access social media or use

camera functions, including video calls.”; and

by inserting after section ___ the following section:-

“SECTION ___.  Chapter 90 of the General Laws is hereby amended by adding the following section:-

Section 13D.

(a)No motor vehicle registered in the commonwealth shall be equipped with, nor shall be used therein, a television receiver, video monitor, or a television or video screen, or any other similar means of visually displaying a television broadcast or video signal that produces entertainment or business applications, is operating and is located in the motor vehicle at a point forward of the back of the driver’s seat, or is operating and the monitor, screen, or display is visible to the driver while driving the motor vehicle. The operator of a motor vehicle that is not required to be registered in the commonwealth shall not operate a television receiver, video monitor, or a television or video screen or any other similar means of visually displaying a television broadcast or video signal that produces entertainment or business applications that violates the provisions of this section while driving in the commonwealth.

The prohibitions contained in this subsection shall not, however, include:

1.Electronic displays used in conjunction with vehicle navigation and mapping systems, or as part of a digital dispatch system;

2.Closed circuit video monitors designed to operate only in conjunction with dedicated video cameras and used in rear-view systems on trucks, motor homes, and other motor vehicles;

3.Television receivers or monitors used in government-owned vehicles by law-enforcement officers in the course of their official duties;

4.Visual displays used to enhance or supplement the driver’s view forward, behind, or to the sides of a motor vehicle for the purpose of maneuvering the vehicle;

5.A vehicle information display;

6.A visual display used to enhance or supplement a driver’s view of vehicle occupants;

7.Television-type receiving equipment used exclusively for safety or  traffic engineering information; or

8.A television receiver, video monitor, television or video screen, or any other similar means of visually displaying a moving image, if that equipment is factory-installed and has an interlock device that, when the motor vehicle operator is performing one or more driving tasks, disables the equipment so that such moving images are not visible to the motor vehicle operator except as a visual display described in subsections 1 through 7. For the purposes of this subsection, “driving task” means all of the real time functions required to operate a vehicle in on-road traffic, excluding the selection of destinations and waypoints, and including steering, turning, lane keeping and lane changing, accelerating and decelerating.

(b)Except for displays explicitly authorized in subsection b, no driver of any motor vehicle shall view any motion picture or similar video display while driving.”.
