Amendment #1412 to H3900

Tyler's Law

Representatives Jones of North Reading, Ferguson of Holden, Frost of Auburn, Gifford of Wareham, Barrows of Mansfield and Smola of Warren move to amend the bill by adding the following section:-

“SECTION XX. Chapter 111 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by inserting after Section 51 ½ the following new section:-

SECTION 51 ¾. Fentanyl testing

(a) This section shall be known, and may be cited, as Tyler’s Law.

(b) If a person is treated at a general acute care hospital and the hospital conducts a urine drug screening to assist in diagnosing the patient’s condition, the hospital shall include testing for fentanyl in the urine drug screening.

(c) As used in this section, “urine drug screening” means a chemical analysis intended to test patients for the presence of multiple drugs, including cocaine, opioids, and phencyclidine.

(d) The Department of Public Health is hereby authorized and directed to promulgate or revise any regulations necessary to implement the testing requirements outlined above.”
