Amendment #142 to H3900

Providing for Smart Growth Opportunities Near Transit

Mr. Vitolo of Brookline moves to amend the bill by adding the following section:

"SECTION XX. Subsection (a) of section 3A of chapter 40A of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by adding the following 3 paragraphs:-

(2) Notwithstanding any general or special law to the contrary, the requirement of first-floor uses consistent with a commercial corridor is consistent with multi-family housing as described in this section.

(3) In rapid transit communities and MBTA communities that are gateway cities, the department of housing and community development shall promulgate guidelines that allow the requirement of first-floor uses consistent with a commercial corridor where doing so does not render the development of that parcel for mixed use including multi-family to be unlikely.

(4) In any place where first-floor uses consistent with a commercial corridor are required, square footage associated with that requirement shall not count towards compliance with this section.”
