Amendment #1427 to H3900
An Act releasing certain land use restrictions held by the department of conservation and recreation
Mr Turco of Winthrop moves to amend the bill by adding the following section:
"SECTION XXXX
SECTION 1. Notwithstanding any general or special law to the contrary, the restrictions held by the department of conservation and recreation as successor in interest to the board of metropolitan park commissioners, granted to it through the Department of Conservation and Recreation by William Cordingley and Jessie Cordingley, recorded on November 19, 1897 with the Suffolk County Registry of Deeds in Book 2486, Page 135, by releasing therefrom the land area shown as Lots 14, 15, and 16 on a plan entitled “Plan of Land of the North Shore Land Co. Situated at Revere Mass.” prepared by Whitman & Breck Surveyors, recorded with the Suffolk County Registry of Deeds on the last page of Book 1333 shall be released.
The consideration for the release of restrictions shall be the difference between the fair market unrestricted value or the value in proposed use, whichever is greater, and the restricted value as determined by an independent appraisal commissioned by the commissioner of the department of conservation and recreation. Upon receipt of such consideration by the recipient of the release, the department shall forthwith record sufficient documentation of such release with the Suffolk county registry of deeds.
The commissioner shall submit the appraisal and a report thereon to the inspector general. The inspector general shall review and the appraisal and the review shall include an examination of the methodology utilized for the appraisal. The inspector general shall prepare a report of the review and file the report with the commissioner. The commissioner shall submit copies of the appraisal, the report thereon and the inspector general’s review and approval and comments, if any, to the house and senate committees on ways and means prior to the execution of any grant of release authorized in this act.
The recipient of the release shall assume all costs associated with engineering, surveys, appraisals, deed preparation and other expenses deemed necessary by the department to execute the conveyances authorized in this act."
