Amendment #36 to H4135

Inspections of Licensees

Representatives Jones of North Reading, Ferguson of Holden, Gifford of Wareham, Frost of Auburn, Barrows of Mansfield and Smola of Warren move to amend the bill in section 46, in subsection (j), by striking lines 1190 through 1197, inclusive, and inserting in place thereof the following subsection:

"(j) The local licensing authority shall enter, up to 1 time per calendar year, during regular business hours, the business premises of any licensee, and shall make inquiries and inspect the licensee’s records, inventory, policies and procedures for the purpose of enforcing the provisions of this section. Licensees found to be in violation of this section shall be subject to the suspension or revocation of their license to sell. The executive office of public safety shall promulgate rules and regulations to effectuate the purposes of this subsection. Nothing herein shall prohibit any other law enforcement agency from conducting such inspections pursuant to a valid search warrant issued by a court of competent jurisdiction."
