Amendment #9 to H4167

Community Preservation Trust Fund

Mr. Schmid of Westport moves to amend the bill by adding the following section:

"SECTION XXXX. Notwithstanding any general or special law to the contrary, prior to transferring the consolidated net surplus in the budgetary funds for fiscal year 2023 to the Commonwealth Stabilization Fund pursuant to section 5C of chapter 29 of the General Laws, the comptroller shall transfer $30,000,000 to the Massachusetts Community Preservation Trust Fund established in section 9 of chapter 44B of the General Laws.  Should the amount available in the consolidated net surplus be less than $30,000,000, the comptroller shall transfer the balance from the Transitional Escrow Fund established in section 16 of chapter 76 of the acts of 2021, as amended by section 4 of chapter 98 of the acts of 2022, so that the total amount transferred shall equal $30,000,000".
