Amendment #1 to H4643

Allowing spouses to serve as caregivers

Representatives Scanlon of North Attleborough and Orrall of Lakeville move to amend the amendment by adding the following new section:

"SECTION XXXX.  (a) Chapter 118E of the General Laws is hereby amended by inserting after section 13L the following section:-

Section 13M. To the extent permitted under federal law, spouses shall be authorized to serve as paid caregivers in the MassHealth program for the provision of certain home-based care and services.

(b) The executive office of health and human services shall file a state plan amendment or waiver application, as may be required, to implement this act no later than 6 months following the effective date of this act.
