Amendment #25 to H4643

Protecting Essential Services for Communities

Representatives Barber of Somerville and Kushmerek of Fitchburg move to amend the amendment in Section 116(c) by inserting at the end the following:

 

"If a hospital executes a plan to discontinue an essential health service, said plan not having been approved by the department pursuant to this section, the Attorney General shall seek an injunction to require that the essential health service be maintained for the duration of the notice period. Additionally, a hospital shall not be eligible to have an application approved pursuant to section 25C for a period of three years from the date the service is discontinued, or until the essential health service is restored."
