Amendment #10 to H4789

Preventing Marijuana Retailer Licensure Monopolization

Ms. Montaño of Boston moves to amend the bill in Section 16 of chapter 94G of the General Laws is hereby amended by striking out the existing language in its entirety and inserting in place thereof the following section:

 

"Section 16. No licensee shall be granted more than 3 marijuana retailer licenses, 3 medical marijuana treatment center licenses, 3 marijuana product manufacturer licenses or 3 marijuana cultivator licenses; provided, however, that a licensee may hold 3 marijuana retailer licenses, 3 medical marijuana treatment center licenses, 3 marijuana product manufacturer licenses and 3 marijuana cultivator licenses and may become a person or entity having direct control or person or entity having indirect control of up to 4 additional marijuana retailer licenses if (i) such marijuana retailer licenses are majority owned by a social equity business; and (ii) such person or entity owns directly or indirectly through a parent or holding company, trust, or otherwise, no more than 49 percent or more of the interest of the social equity business."
