Drug Reimbursements

Messrs. Eldridge and Tarr move that the proposed new draft be amended by inserting at the end of Section 49 the following sentence:-

“Further, a carrier must provide a reasonable administrative appeal process to allow pharmacies to challenge reimbursements for a particular drug and a pharmacy or pharmacist may decline to provide the pharmacy services to a patient or to a pharmacy benefit manager if a pharmacy or pharmacist is to be paid less than the pharmacy acquisition cost of the pharmacy providing the services.”
