Increasing Penalty for Illegal Possession of a Firearm in the Home

Messrs. Velis, O'Connor, Moore, Timilty and Pacheco move that the proposed new text be amended by adding the following sections:-

"SECTION X. Subsection (h)(1) of section 10 of chapter 269, as so appearing, is amended by striking out the words “a jail or house of correction for not more than 2 years or by a fine of not more than $500. Whoever commits a second or subsequent violation of this paragraph shall be punished by imprisonment in a house of correction for not more than 2 years or by a fine of not more than $1,000, or both” and inserting in place thereof, “the state prison for not more than 5 years or in a house of correction for not more than 2 ½ years, or by a fine of not more than $1000, or both.”

SECTION XX. Subsection (d) of section 10 of chapter 269, as so appearing, is hereby amended by striking out the words “(a), (b), or (c),” each time it appears in said subsection and inserting in place thereof the following words:-  (a), (b), (c), or (h)(1),”."
