Redraft Amendment 58

Sensible Firearm Reform

Messrs. Velis, O'Connor and Tarr move that the proposed new text be amended by adding the following section:- 

SEXTION X. There shall be a commission to study, investigate, and make recommendations on sensible gun reform. The commission shall consist of: 1 member appointed by the speaker of the house of representatives, who shall serve as co-chair; 1 member appointed by the president of the senate, who shall serve as co-chair; the chairs of the joint committee on the judiciary; the secretary of public safety and security or a designee; the colonel of the state police or a designee;; 1 member appointed by the minority leader of the house of representatives; 1 member appointed by the minority leader of the senate; 2 persons appointed by the governor, 1 of whom shall be an expert in emerging firearm technologies; the attorney general or a designee; and 1 person appointed by the department of criminal justice investigative services.

The Commission’s focus shall include, but not be limited to: (i) an evaluation of the resources available to the Commonwealth to comply with its burdens regarding firearm reform; (ii) an investigation into amount of violent crime committed by unlawful gun possession; (iii) a review of the process of safekeeping confiscated firearms; (iv) an evaluation of the needs created by Commonwealth v. Guardado; and (v) a review of the ability of the department of criminal justice investigative services to respond to requests for agents to attend trial.

The commission shall submit a report of its study and recommendations on sensible gun reform, together with any legislative recommendations, to the clerks of the house of representatives and the senate not later than December 15, 2024.
