Proving Possession of Large Capacity Weapon or Feeding Device

Messrs. Velis, O'Connor, Moore, Timilty, Brady and Collins move that the proposed new text be amended by adding the following section:-

"SECTION X. Subsection (m) of section 10 of chapter 269, as so appearing, is amended by striking out, in the first sentence of said subsection, the word 'knowingly' each time it appears and inserting at the end of that sentence the following words:- 'Where a party is unlicensed, it shall be sufficient to prove a violation of this subsection to prove that a party was knowingly in possession of a weapon or feeding device, and that such weapon or feeding device was in fact large capacity.  The Commonwealth need not separately prove knowledge of the large capacity status of the weapon or feeding device.'."
