Excluding School and Youth Areas

Messrs. Moore, Tarr and Montigny move that the proposed new text be amended in section 5, in line 97, by inserting after the word "program." the following sentence:- "The board of health, select board or city council, or the department shall not approve an application where the property where the proposed site is to be located, at the time the application is received by the board of health, select board or city council or department, is located within 500 feet of: (1) a public or private school where children attend classes in preschool programs, kindergarten programs or grades 1 to 12, inclusive; (2) any licensed daycare or childcare site; or (3) or youth center."
