The committee on Ways and Means, to whom was referred the Senate Bill authorizing the town of Tewksbury to use a certain parcel of land for general recreational purposes (Senate, No. 2916), reports recommending that the same ought to pass with an amendment striking all after the enacting clause and inserting in place thereof the text contained in House document numbered 4971.

Text of an amendment, recommended by the committee on Ways and Means, to the Senate Bill authorizing the town of Tewksbury to use a certain parcel of land for general recreational purposes (Senate, No. 2916). August 1, 2024.

By striking out all after the enacting clause and inserting in place thereof the following:–
 

SECTION 1. Section 1 of chapter 314 of the acts of 1993 is hereby amended by striking out the words “the expansion of the town of Tewksbury baseball facilities” and inserting in place thereof the following words:- general recreational purposes, including, but not limited to, Tewksbury baseball facilities and other active and passive recreational activities.

SECTION 2. Notwithstanding sections 32 to 37, inclusive, of chapter 7C of the General Laws, section 2 of chapter 314 of the acts of 1993 or any other general or special law to the contrary, the commissioner of capital asset management and maintenance may amend the restriction in a deed recorded in the Middlesex northern district registry of deeds in book 10054, page 109 to allow the parcel of land described therein to be used for general recreational purposes.

SECTION 3. The town of Tewksbury shall be responsible for all costs and expenses of any transaction authorized in this act as determined by the commissioner of capital asset management and maintenance, including, but not limited to, the costs of any recording fees or deed preparation.
