Preventing Price Gouging during an Emergency

Messrs. Tarr and Montigny moved that the proposed new text be amended by inserting after section ___ the following section:-

"SECTION_. Chapter 93A as appearing in the 2018 official edition is hereby amended by inserting after SECTION 11 at the end thereof the following new section 12:-

SECTION 12. For the purposes of paragraphs (1) and (2) and (3), the following words shall, unless the context otherwise requires, have the following meaning:

“Market emergency”, any abnormal disruption of any market for petroleum products, including but not limited to any actual or threatened shortage in the supply of petroleum products or any actual or threatened increase in the price of petroleum products, resulting from severe weather, convulsion of nature, failure or shortage of electric power or other source of energy, strike, civil disorder, act of war, national or local emergency or other extraordinary adverse circumstances.

“Petroleum product”, includes, but is not limited to, motor fuels as defined in section 295A and fuel oil used for heating or cooking purposes as described in section 303F of chapter 94.

“Petroleum-related business”, any producer, supplier, wholesaler, distributor, or retail seller of any petroleum product.

(1) It shall be an unfair or deceptive act or practice, during any market emergency, or any declared statewide emergency, for any petroleum-related business to sell or offer to sell any petroleum product for an amount that represents an unconscionably high price.

(2) A price is unconscionably high for the purposes of paragraph (1) of this section if:

(a) the amount charged represents a gross disparity between the price of the petroleum product and

1. the price at which the same product was sold or offered for sale by the petroleum-related business in the usual course of business immediately prior to the onset of the market or statewide emergency, or

2. the price at which the same or similar petroleum product is readily obtainable by other buyers in the trade area; and

(b) the disparity is not substantially attributable to increased prices charged by the petroleum-related business suppliers or increased costs, including actual or anticipated replacement costs, due to an abnormal market disruption.

(3).  A price is not unconscionably high for the purposes of paragraph (1) of this section if:

(a) the disparity in price as set forth in paragraph (2) of this section is substantially attributable to increased prices charged by the petroleum-related business’s suppliers or increased costs, including actual or anticipated replacement costs, due to an abnormal market disruption; or

(b) it is generally consistent with price fluctuations in applicable commodity, regional, national, or international markets, or typical seasonal price fluctuations; or

(c) it is a contract price, or the result of a price formula, established prior to the onset of the market or statewide emergency, or

(d) it is a price, or the result of a price formula, approved by a state or federal governmental entity prior to the onset of or after the market or statewide emergency.

(4). It shall be an unfair or deceptive act or practice, during any declared statewide or national emergency, for any business at any point in the chain of distribution or manufacture to sell or offer to sell to any consumer or to any other business any goods or services necessary for the health, safety, or welfare of the public for an amount that represents an unconscionably high price.

(5). A price is unconscionably high for the purposes of paragraph 4 of this section provided the following:

(a) there is gross disparity between the price charged or offered; and

1. the price at which the same good or service was sold or offered for sale by the business in the usual course of business immediately prior to the onset of the declared statewide or national emergency; or

2. the price at which the same or similar product is readily obtainable from other businesses; and

(b) the disparity is not substantially attributable to increased prices charged by the business’s suppliers or increased costs due to an abnormal market disruption

(6). Paragraphs (4) and (5) above shall not apply to any petroleum-related business subject to paragraph (1), (2), and (3) of this section."

Notwithstanding chapter 40A of the general laws or any special permit, variance or any other general or special law to the contrary, a city or town may approve requests for expansion of outdoor table service or extensions of earlier granted approvals, including a local licensing authority ("LLA") approving a request for a change description of licensed premises for the purpose of permitting outdoor alcohol and or service.  For the purposes of this section "outdoor table service" shall mean restaurant service that includes food prepared on-site and under food permits issued by municipal authorities pursuant to 105 CMR 590.00 that is served to seated diners outside the restaurant building envelop, whether on a sidewalk, patio, deck, lawn, parking area, or other outdoor space."

Accessory Dwelling Units

Messrs. Tarr and O'Connor and Ms. Edwards moved that the proposed new text be amended by inserting after section _ the following section:-

SECTION_. Section 3 of chapter 40A of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by inserting after the last paragraph the following 3 paragraphs: -

No zoning ordinance or by-law shall prohibit or require a special permit for the use of land or structures for an accessory dwelling unit, or the rental thereof, in a single-family residential zoning district on a lot with 5,000 square feet or more or on a lot of sufficient area to meet the requirements of title 5 of the state environmental code established by section 13 of chapter 21A, if applicable; provided, however, that the single-family dwelling or the accessory dwelling unit is occupied by at least 1 person with disabilities or 1 person who is elderly.

As used in this section, “accessory dwelling unit” shall mean a self-contained housing unit, inclusive of sleeping, cooking and sanitary facilities, incorporated within the same structure as a single-family dwelling or in a detached accessory structure and that: (i) maintains a separate entrance, either directly from the outside or through an entry hall or corridor shared with the single dwelling; (ii) shall not be sold separately from the single family dwelling; (iii) is not smaller in floor area than 450 square feet; (iv) may include up to two bedrooms; and (v) is not larger in floor area than ½ the floor area of the single family dwelling or 900 square feet, whichever is smaller; “person with disabilities” shall mean a person who has been determined to be disabled (i) in accordance with criteria established by local by-law or ordinance, if any, or (ii) by the Social Security Administration or MassHealth, notwithstanding any local by-law or ordinance; and “elderly” shall mean a person sixty-five years of age or older.

The zoning ordinance or by-law may require that the single-family dwelling or the accessory dwelling unit be owner-occupied and may limit the total number of accessory dwelling units in the municipality to a percentage not lower than 5 percent of the total non-seasonal housing units in the municipality. The use of land or structures for an accessory dwelling unit may be subject to reasonable regulations concerning dimensional setbacks and the bulk and height of structures. Not more than 1 additional parking space shall be required for an accessory dwelling unit but, if parking is required for the single family dwelling, that parking shall either be retained or replaced. An accessory dwelling unit allowed under this section is considered owner-occupied upon transfer of title of the single-family dwelling in whole or in part to a trust in which at least 1 beneficiary is a person with disabilities or a person who is elderly; provided, however, that either the single-family dwelling or the accessory dwelling unit remains occupied by that beneficiary. Nothing in this paragraph shall authorize an accessory dwelling unit to violate the building, fire, health or sanitary codes, historic or wetlands laws, or ordinances or by-laws.

SECTION _. Chapter 40B of the general laws as so appearing is hereby amended by inserting at the end thereof the following new section:-     

 Section_. Any Accessory Dwelling Unit as is defined in Section 3 of Chapter 40 A shall constitute an addition to the required number of affordable housing units subject to Chapter 40 B. No such Accessory Dwelling unit shall constitute the need for a public hearing as is required under Section 11 of Chapter 40A.

Allowing Moveable Tiny Houses as Permanent Residential Dwellings and Accessory Dwelling Units

Mr. Tarr, Ms. Gobi and Mr. O'Connor moved that the proposed new text be amended by inserting after section ___the following section:-

"SECTION___. Section 1A of chapter 40A of the General Laws, as amended by chapter 358 of the acts of 2020, is hereby further amended by inserting after the definition of “MBTA community”  the following definition:-

“Movable tiny house", a transportable dwelling unit built on a frame or chassis with not more than 400 square feet, excluding lofts, projections from bay windows, open decks, porches or exterior utility and storage compartments, intended for residential use on an individual house lot where single-family dwellings are allowed or as an accessory dwelling unit; provided, however, that a “movable tiny house” shall be permanently affixed to a chassis approved by the Massachusetts Department of Transportation capable of carrying the total weight of the structure and the exterior width shall not exceed any dimension prohibited by the Massachusetts Department of Transportation for movement on a public way or highway; provided further, that a “movable tiny house” shall be built in conformance with the regulations and standards of the state building code but shall not be required to have insulation in walls and floors exceeding R-13 or in ceilings exceeding R-18.

SECTION 2. Section 3 of said chapter 40A, as is hereby amended by adding the following 4 paragraphs:-

The Massachusetts Department of Transportation, registry of motor vehicles and the secretary of the commonwealth shall establish a new category for movable tiny houses. The registry of motor vehicles shall establish a process to apply for, issue and cancel certificates of title for movable tiny houses that meet all additional safety and equipment requirements established by the registry of motor vehicles; provided, however, that the registration fee for said certificates of titles for movable tiny houses and manufactured movable tiny houses shall be $100.

A movable tiny house may be placed on a lot as defined in section 1A of chapter 40A of the General Laws and lived in for not less than 180 days before an on-site inspection; provided, however, that after 180 days, a movable tiny house shall be required to have an established address, energy and water source and wastewater system; provided further, that after 180 days, the authority having jurisdiction of said lot shall provide for the inspection of the moveable tiny house by a certified member of a third-party inspection agency and if the moveable tiny house meets the standards of the inspection a certificate of occupancy shall be issued.

Notwithstanding any general or special law to the contrary, a city or town may establish less restrictive rules and regulations than are permitted by this section; provided, however, that a city or town shall not establish design criteria having the effect of excluding movable tiny houses.

A city or town may incentivize hosted parking of movable tiny houses with tax abatements or other tax incentives."

“Ticket reseller shall mean any person, entity, corporation or association engaged in the business of reselling, offering for resale, or negotiating the resale of tickets of admission or other evidence of right of entry to any sporting event, theatrical exhibition, public show, or public amusement or exhibition, including officers, agents and employees of such person, entity, corporation, or association. A person, entity, corporation, or association shall be deemed to be “engaged in the business of resale” if such person, entity, corporation, or association has sold more than 100 sets of tickets by means of telephone, mail, delivery, service, facsimile, internet, email, or other electronic means in the preceding twelve months. A resale shall not include the initial sale of any event ticket by the ticket issuer.

SECTION XXX Section 185A of Chapter 140 of the General Laws, as appearing, is hereby amended by inserting at the end thereof the following:-

As used in this chapter, the following words shall have the following meaning:

“Non-Transferable Ticketing System” means restricting, though contractual or technological means, a ticket purchaser’s ability to freely give away or resell the tickets they have purchased through a ticket platform that is not affiliated with the ticket issuer.

“Ticket issuer” means any person that makes tickets available, directly or indirectly, to an entertainment event, and may include the operator of a venue; the sponsor or promoter of an entertainment event; a sports team participating in an entertainment event or a league whose teams are participating in an entertainment event; a theatre company, musical group or similar participant in an entertainment event; or an agent of any such person.

“Ticket Platform” means a marketplace that enables consumers to purchase and sell tickets.

SECTION XXXX Section 185A of chapter 140 of the General Laws, as so appearing, is hereby amended by deleting the second paragraph of this section.

SECTION XXXXX. Chapter 140 of the General Laws, is hereby amended by striking out section 185D, as so appearing, and inserting in place thereof the following section:-

Section 185D. Consumer protection standards relative to the purchase, sale, and resale of tickets:

(a) Any person who resells a ticket shall:

(1) Maintain a toll-free telephone number, e-mail address, or other means of contact for complaints and inquiries regarding the resale of event tickets;

(2) Implement and reasonably publicize a standard refund policy that meets the minimum standards established in subsection (c); and

(3) Take responsible measures to safeguard against the resale of counterfeit tickets.

(b) Any person who resells a ticket can meet the requirements of subsection (a) by using a ticket platform that meets the requirements of subsection (a).

(c) The standard refund policy in subsection (a)(2):

(1) Shall provide a consumer who purchases an event ticket a full refund if: (i) the event ticket does not provide access to the event or venue of the event, provided the date and time of the event are correct on the event ticket; (ii) the event ticket has been cancelled by the ticket issuer for non-payment by the original purchaser, or for any reason other than an act or omission of the consumer; (iii) the event ticket materially and to the detriment of the consumer fails to conform to the description provided to the consumer; or (iv) the event ticket was not delivered to the consumer prior to the occurrence of the event, unless such failure of delivery was due to any act or omission of the consumer;

(2) Shall include the full order value paid by the consumer for the event ticket, together with any fees charged in connection with that purchase, including but not limited to convenience fees, processing fees, at-home printing charges, and

(3) May condition entitlement to a refund upon timely return of the ticket purchased, and may include reasonable safeguards against abuse of the policy.

(d) Provision of a replacement ticket to the same event that is in a comparable location, at no additional charge to the consumer, shall be considered providing a full refund for the purposes of subsection (c).

(e) If an event is canceled and not rescheduled, consumers are entitled to a full refund as provided in subsection (c)(2) from the person, ticket issuer, or ticket platform they directly purchased the ticket from.

(f) Nothing in this section shall be construed to prohibit any person, entity or association, or an agent of any such person, entity or association subject to this section from implementing consumer protection policies that exceed the minimum standard set forth in this section, and that are otherwise compliant with this act.

(g) A person may not knowingly use or sell software to circumvent a security measure, access control system, or other control or measure used by a ticket issuer or ticket platform to enforce event ticket purchasing limits or to maintain the integrity of online ticket purchasing order rules.

(h) Notwithstanding any contrary terms or conditions, a) a ticket issuer may employ a non-transferable ticketing system only if the consumer is offered an option at the time of initial sale to purchase the same ticket in a transferable form that allows tickets to be given away or resold independent of and without requiring the consumer to log into the ticket issuer’s preferred ticket platform, without penalty or discrimination, and b) a ticket buyer or seller shall not be penalized, discriminated against, or denied access to an event solely on the grounds that, or the ticket platform through which, the ticket or tickets were resold.

SECTION XXXXXX Said chapter 140, as so appearing, is hereby amended by adding after section 185H following new section:-

Section 185I. Notwithstanding any other provision of this chapter, a ticket issuer or venue operator may:

a) Maintain and enforce policies with respect to conduct, behavior, public health and safety, or age at the venue or entertainment event;

b) Establish limits on the quantity of tickets that may be purchased;

c) Elect not to offer tickets in a transferable form as required by the provisions of section one hundred and eight-five D if those tickets are sold or given to individuals or groups as part of a private event, or a targeted promotion at a discounted price offered because of the individuals or groups status or affiliation with religious or charitable institutions, societies or organizations or civic leagues or organizations not organized for profit but operated exclusively for the promotion of social welfare, associations of veterans of any wars of the

United States, students, or groups or individuals characterized by a disability or economic hardship. Tickets issued through a non-transferable ticketing system pursuant to the exemption in this subsection shall not be offered promotionally to the general public and must be clearly marked as a ticket restricted to the specified individual or group."

Promoting Economic Opportunities for Cottage Food Entrepreneurs

"SECTION 1. Section 146 of chapter 94 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by inserting, in line 51, after the word “health.”, the following words:- Local boards of health shall not establish rules or regulations for cottage food operations.

SECTION 2. Section 1 of chapter 94 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by inserting after the definition of ‘cosmetic’ the following definitions:- ‘cottage food operation’, in sections 146 and 330, is a person who produces cottage food products only in the home kitchen of that person’s domestic residence for retail sale directly to the consumer either in person, including but not limited to farmers markets, public events, and roadside stands, by telephone, internet, or mail delivery. ‘Cottage food product’ in section 330, is a non-time/temperature control for safety food including but not limited to baked goods, jams or jellies, and other non-time/temperature control for food safety food produced at a cottage food operation.

SECTION 3. Said chapter 94 of the General Laws, is hereby further amended by inserting after section 329 the following section:- Section 330. (a) Other than requirements set forth in this section, a cottage food operation is exempt from permitting, licensing, inspection, packaging, and labelling requirements for food establishments set by State law, the Department of Public Health, and local boards of health.

(b) This section does not exempt a cottage food business from any applicable State or federal tax laws.

(c) Nothing in this chapter shall be construed to impede the Department of Public Health or local health boards in any investigation of a reported foodborne illness.

(d) Nothing in this chapter shall preclude the Department of Public Health or local health boards from providing assistance, consultation, or an inspection at the request of the producer of a cottage food product.

(e) Cottage food operations must provide the following information to the consumer:

(1) the cottage food operation’s name;

(2) the cottage food operation’s address or personal identification number;

(3) the common or usual name of the cottage food product;

(4) the ingredients of the cottage food product in descending order of predominance; and

(5) the following statement: “This product was produced at a private residence that is exempt from Massachusetts licensing and inspection requirements. This product may contain allergens.”

(f) The information required in subsection (e) must be provided:

(1) on a label affixed to the package if the cottage food product is packaged;

(2) on a label affixed to the container, if the cottage food product is offered for sale from a bulk container;

(3) on a placard displayed at the point of sale, if the cottage food product is neither packaged nor offered for sale from a bulk container; or

(4) on the webpage on which the cottage food product is offered for sale if the cottage food product is offered for sale on the internet.

(5) If the cottage food product is sold by telephone or custom order, the seller need not display the information required by section, but the seller must disclose to the consumer that the cottage food product is produced at residential kitchen that is exempt from state licensing and inspection requirements; and may contain allergens.

(g) The Department of Public Health shall establish and maintain a voluntary cottage food operation registry. The voluntary cottage food operation registry shall only allow the Department of Public Health to issue personal identification numbers for cottage food product labels as an alternative to the cottage food operation’s address. The Department of Public Health shall issue a personal identification number to cottage food operators who have submitted applications for the registry that are approved by the Department of Public Health and have paid the registration fee. The Department of Public Health may charge a fee, not to exceed $25, to each cottage food operation registrant.

(h) The Department of Public Health shall make available an application for the cottage food operation registry that provides for the following:

(1) the cottage food operator’s full name,

(2) the cottage food operation’s address,

(3) the cottage food operation’s primary telephone number, and

(4) the cottage food operation’s primary email address.

(i) The cottage food operation shall update the Department of Public Health when there is a change to any of the registration details including their name, residential kitchen address, telephone number, and email address.

(j) The Department of Public Health shall not require cottage food operators to register for a personal identification number."

Commonwealth Competitiveness Commission

Messrs. Fattman and O'Connor moved that the proposed new text be amended by inserting after section ___ the following section:-

"SECTION XX. Notwithstanding any general or special law to the contrary, there is hereby established a special commission and study on the competitiveness of the Massachusetts economy. The commission shall investigate the high costs of conducting business in the Commonwealth, high costs of housing, rise of remote work, and the net out-migration of Massachusetts residents. The commission shall document recommended steps that should be taken to make Massachusetts economically attractive and competitive. The commission shall consist of the secretary of housing and economic development or a designee; 1 member of the house of representatives appointed by the speaker of the house of representatives; 1 member of the senate appointed by the senate president; 1 member of the house of representatives appointed by the minority leader of the house of representatives; 1 member of the senate appointed by the senate minority leader; 2 members appointed by the governor, 1 of whom shall be an individual with expertise in housing development and 1 of whom shall be an individual with expertise in business development; 2 members of the Massachusetts High Technology Council; 2 members of the Massachusetts Taxpayers Foundation; 1 member of the Citizens’ Housing and Planning Association (CHAPA); 1 member of the Massachusetts Growth Capital Corporation (MGCC); and 1 member of a chamber of commerce from each county, or a designee, appointed by the governor. The executive office of housing and economic development and its subdivisions shall provide technical support to the commission. The commission shall file its report and recommendations with the clerks of the house and senate, the house and senate chairs of the joint committee on economic development and emerging technologies, and the house and senate chairs of the joint committee on housing not later than June 30, 2024."
