Anaerobic Digester Incentive Program

Messrs. Finegold, Tarr, Brady and O'Connor moved that the proposed new text be amended by inserting after section 53 the following section:-

“SECTION 53A. Subsection (e) of section 17 of chapter 25A of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by striking the first sentence and inserting in place thereof the following sentence:-

Anaerobic digestion biogas-to-energy and landfill gas-to-energy facilities, referred to in this subsection as “anaerobic digestion facilities”, that are located in the commonwealth and are both operational and qualified as Class 1 renewable energy generating sources pursuant to section 11F prior to November 7, 2021 shall be eligible for an incentive program via a 1-time procurement for Class 1 renewable certificates which are generated by existing anaerobic digestion facilities.”
