Requiring Timely Notification of Junior Operator License Suspensions

Ms. Creem moved that the proposed new text be amended by inserting after section __ the following section: -

SECTION __. Section 8 of chapter 90 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by inserting, in line 168, after the word “and”, the following:- “, separately,”

SECTION __. Said section 8 of said chapter 90 is hereby further amended by inserting, in line 170, after the word “minor”, the following:- “. Such notice shall be sent within 30 days of the disposition of the violation that triggered the suspension of the junior operator’s license. The registrar shall include in any such notice (i) information on the requirement that the junior operator complete the state courts against road rage program sponsored by the trial court and the department of the state police; and (ii) information on the license reinstatement process, including, but not limited to: (1) information on any reinstatement fees and surcharges; (2) information on the requirement that the junior operator complete a program selected by the registrar that encourages attitudinal changes in young drivers; and (3) information on the requirement that the junior operator successfully complete a driving test as required by the registrar”

SECTION 18B. The eighth paragraph of said section 8 of said chapter 90, as so appearing, is hereby amended by inserting after the first sentence the following 2 sentences:- Such notice shall be sent within 30 days of the disposition of the violation that triggered the suspension of the junior operator’s license. Identification for youth and adults experiencing homelessness

Ms. Kennedy, Mr. Eldridge, Ms. Rausch, Mr. Gomez, Ms. Miranda, Mr. Feeney, Ms. Gobi, Ms. Jehlen, Messrs. Keenan and Montigny, Ms. Edwards, Messrs. O'Connor and Cyr and Ms. Lovely moved that the proposed new text be amended by inserting the following section:-

“SECTION ___. Section 8E of chapter 90 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by adding the following 2 paragraphs:-

The regulations establishing criteria for identification cards shall include a process for a person who is homeless or is an unaccompanied homeless youth to apply for a Massachusetts identification card and to waive any fees associated with obtaining the identification card; provided, however, that the process shall allow for a person who is homeless or is an unaccompanied homeless youth to submit proof of residency by providing documentation that is satisfactory to the registrar and that is: (i) from an entity that provides housing services or youth services in the Commonwealth, including, but not limited to, homeless service providers; or (ii) evidence of services that the person received from a department, division, office or agency of the executive office of health and human services. The registrar and the state secretary shall enter into a memorandum of understanding under section 42G ½ of chapter 51 to implement this paragraph, as appropriate.

For the purposes of this section, the following terms shall have the following meanings:

“Homeless”, shall have the same meaning as in section 103 of the federal Stewart B. McKinney Homeless Assistance Act of 1987, 42 USC 11302, as amended.

“Unaccompanied homeless youth”, a person who: (i) is 24 years of age or younger; (ii) is not in the physical custody or care of a parent or legal guardian; and (iii) lacks a fixed, regular and adequate nighttime residence.”

SECTION 35B. Subsection (c) of said section 53 of said chapter 176 is hereby amended by striking out the figure “2023” and inserting in place thereof the following figure:- 2024.”; and

by inserting after section 58 the following section:-_

“SECTION 58A. Sections 35A and 35B shall take effect as of June 1, 2023.”

Section 53 of Chapter 176 of the acts of 2022 hereby amended by striking out the words "The commission shall consist of: the First Suffolk member of the senate, who shall serve as co-chair; the Fourth Suffolk member of the house of representatives who shall serve as co-chair; the secretary of transportation or a designee; the secretary of public safety and security or a designee; the executive director of the Massachusetts Port Authority or a designee; the executive director of Massachusetts Convention Center Authority or a designee; the director of the Boston Planning and Development Agency or a designee; the mayor of the city of Boston or a designee; and the district 2 Boston city councilor or a designee." and inserting in place thereof the following:- the commission shall consist of: the Congressman representing the 8th Congressional District or a designer; the First Suffolk member of the senate, who shall serve as co-chair; the Fourth Suffolk member of the house of representatives who shall serve as co-chair; the executive director of the Massachusetts Port Authority or a designee; the President of the Boston Marine Park Business Association or designee; the President of the South Boston Citizens Association or designee; the director of the Boston Planning and Development Agency or a designee; the mayor of the city of Boston or a designee; and the district 2 Boston city councilor or a designee.

Section 2 of chapter 90 of the General Laws, as appearing in the 2018 Official Edition, is hereby amended by striking out, in lines 466-469, the following words:- “There shall be an annual $20 fee for such “VETERAN” plates in addition to the established registration fee for private passenger motor vehicles and motorcycles.”
